Continuation of an old thread, Parking invoice turned into CCJ and harassment from a new debt compan

Hi All,

My old thread https://forums.moneysavingexpert.com/discussion/4665883/ticked-from-ukps-for-displayinh-invalid-permit&page=2

Long story short, I decided to run a credit check due to an idea of taking a mortgage...how was I surprised to find out I have 2 CCJ's for unpaid parking invoices. Since my last thread I moved out from my previous address and apparently debt company tried everything to reach out to me. About a week ago I started getting 2-3 texts + few more phone calls...a day! from a company who acts in interest of their client to recover the debt. I didn't give them any of my details (other that they already have) but started corespodnece due to thinking its about speeding ticket from few years ago(all been paid for in 2016, that was the only reason of me actually exchanging any emails as i wanted to get it sorted, thinking that's the case) new debt collectors wouldn't give me any details, other than the name of their customer. It allowed me to get details from CCBC confirming its the matter of 2 invoices from 2013. New company won't give me any details until I confirm my address and all the details. It's actually quite shocking. Any words of advice how to deal with it please? Cheers

Did you receive court papers for those PCNs? If not then you have the option of applying for set-asides. See the Newbies thread, post #2.

Have yo umoved in the intervening time?
    If not
Is the V5C up to date and absolutely correct? DO NOT GUESS - check it now.
If Yes, then it is highly unlikely you will have missed at least 4 court letters - 2 x claim form, 2 x judgements - so do yo uhave issues with post?

To clear these off you will almost certainly need a SET ASIDE, 1 per CCJ, at a cost of £255 EACH. If successful in your set aside and the claim itself, you will usually get this back .
This is the ONLY way to clear your credit history.

I sold the car in september and moved out in November 2014. From details received from court "claimant wrote to defendant on the 26/02/2016 of the intention to issue a summons..." 2nd CCJ states date of the 10/05/2016. I'm not even that bothered about CCJ's...I just want to stop these thieves from scamming me from my money.

You say you aren't bothered about these ccjs, but mentioned a mortgage in your OP

Getting a mortgage with ccjs is going to be difficult/, impossible

Also bear in mind that the Claimant can take enforcement action against you (eg bailiffs/attachment of earnings etc), and you would have to pay all the costs of enforcement.

Assuming these ccjs are over a month old you could consider getting them set aside which if successful would get them off your record.

If under a month old you can pay them off in full within the month since judgement and get them removed from the register

Oh, I'm bothered now. What are the chances that I won't get £500 back and will still have to pay for invoices? Worst thing is I've had a perfect score and these b*stards think they can do whatever they want.

If these ccjs are more than a month old them the only ways to get them off your records are set aside or set aside by consent.

If successful they will be removed.

Read up on these two options (with set aside you face another claim, if you win the subsequent hearing you should get your set aside fee back)

A set aside by consent costs £100, but you pay the ccjs off after getting the claimant to consent to the set aside
