Paying VAT on estate agent fees twice?

Hi All,
Does anyone have experience with solicitors paying the estate agent fee from sale of house? We negotiated a 1.1% + VAT fee for a house we sold at £280000. Which I calculated as £3696. On the completion statement, the agents fees are listed as £4435.20 which is the 1.1% + VAT and then + VAT again!
Should I be paying the VAT twice? doesn't seem fair...
