VCS Parking Claim - Court Claim Issued

Hi, I am new to this forum and have been reading through the newbie and advice posts.


I have recently responded to a court claim form indicating my intent to defend the claim.


Having received PCN NTK letters from VCS followed by debt recovery letters from DRP and Zenith, I had been advised to make no acknowledgement of these. Following an LBC, I've now received the Claim Form.


I like many others had received letters citing a claim for £100 which has now risen to an unwarranted £160.


I am finding this process quite stressful but I am adamant that I should be fighting this charge.

    if the claim form came from Northampton CCBC, then I assume you have done the AOS online by using the MCOL reference on the bottom right of the form ?


    if so, post the DATE OF ISSUE and full POC details below


    then start drafting your defence by reading a few from the NEWBIES FAQ sticky thread , post #2


    was this a private car park or an airport (where bylaws apply )?

    Have you seen the model defence provided by legally qualified and highly experienced in fighting private parking charges - bargepole? You might want to draft yours, drawing on his expert advice.

    If this was a hybrid 'NOT A PARKING CHARGE NOTICE' (myparkingcharge.co.uk) windscreen PCN first in a red envelope, then there is an example VCS defence for that hybrid notice situation in the NEWBIES thread, that I wrote a couple of months ago.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

    Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by in the not too distant future..
    You never know how far you can go until you go too far.
