Data Protection Breach - Advice

Evening all.

I’m after some advice from you financial heroes!

I have been contacted today by a family member (twin brother) informing me that they have created an account with a major credit score company and for some reason are able to view the entirety of my credit history, including my current financial information such as mortgage, credit cards and car finance. Clearly this is not something I would ordinarily share and it has made me quite uncomfortable knowing they have access to this data.

What are my legal rights? Should I (or indeed could I) seek legal advice and subsequent compensaton for a data protection breach.

    What are your actual losses as a result of this?


    Quantify them and complain to the lender and see what they come back with

  • Yes, they have an obligation to protect your data, but it doesn't automatically equate to a cash payout when errors are made.

    Escalate a complaint so that it gets rectified. You may get a goodwill payment.

  • I'd want to know why it happened - and what prevents other people from doing whatever your twin brother did to get access... Obviously you'll share some data (DOB), but I'm guessing as you talk about a mortgage your address history and names are different...

    Names could be similar, e.g. same initial, some parents do that; and depending on how old they are, address history will converge at some point in the past when they both lived at home.

  • No we have different initials and have not lived in the same property for 15 years! My frustration lies with the company and clearly my intent is not to sue my brother... if they are able to accidentally provide critical data they easily it raises concerns as to how safe it is!

    Which one did it appear on in this instance?
  • The CRA was Noddle and it doesn’t occur on any other site that I’m aware of! Guess that’s a positive thing?
