Claim form from Parking Solutions 24

Dear All,

I recently got a CCJ through the post from the County Court Business Centre for a parking ticket I received a while ago from Parking Solutions 24 who are BPA registered. I intend to acknowledge online in good time that I intend to defend it so it will gives me a fair amount of time to mount a defence with your guys help hopefully!

I don't know where to start, so I'll start with some facts:

-There was a fair amount of visible signs, the driver does not dispute this fact but I will take a visit down to try and get pictures over the weekend for lettering

-On the day the driver tried paying with the app PayByPhone, however it was not working and simply would not connect. I do not know how to get proof of this?

On the day the driver had an exam, which they would not have been able to take due to a '15 minutes late rule no entry', had they tried to get money to pay using the pay machines. They have proof of this exam.

I received NTK through the post (which I ignored:()after the offence but I have not received a LBC. It been would probably have paid it then to avoid the extra costs

The driver has records of visiting said car park over a number of years and paying without a problem, again don't know if this helps.

Edit:
-The date on the form is within the previous 5-9 days. Don't want to give the exact date just in case.
-Particulars of claim form is as follows:
-The claimants claim against the defendant is for non payment of a contractually agreed sum. In respect of a parking charge notice issued to the vehicle xxxx on xxx at xxx. For the following reasons; failing to pay for parking to cover the duration of their stay. The terms and conditions to which the defendant agreed to be bound by using the site were clearly displayed in prominent places throughout the site. The claimants claim is inclusive of recovery costs as per the terms and conditions. Notice of which was given to the defendant by way of parking charge notice numbered xxxxx and the claimant claims £120.00 the claimant claims interest etc


I have not had any communication with them at all since the situation took place.

I don't know if any of the above is relevant, or I don't have a foot to stand on. Any comment or help will be grateful. Depending on advice I will either defend or just pay.

    Have you received a County Court Judgment or have you received a Claim Form from the County Court Business Centre in Northampton?

    What is the Date of Issue on your Claim Form?

    Please can you state the contents of the Particulars of Claim box on your Claim Form? Hiding any personal information of course.

    Perhaps I can ask you to edit the title of your thread - maybe replacing CCJ with Claim Form.

    You do not have a CCJ and will not be getting a CCJ.

    Have you still got the notice that they posted (Notice to Keeper) and was there a windscreen PCN?

    Check the NTK against the POFA, was it compliant?

    Send a SAR online* to the phone provider, giving the date and approx time and asking for all data held regarding several failed attempts to connect, if such data is held.



    * most companies have an online privacy page now, following the GDPR, and that says where to send a SAR to, for your right to data access.

    Request has just been sent. Will get a reply by around 30 days time they say.

    LOL! Think about it, you should know the answer to this, given what you have just sent to the phone company!

    A SAR to the parking company...asking for copies of all letters sent, the PCN, all photos, all data held, all status updates and all electronic pages or other notes including the ticketer's own notes about your case. You might just get it back before defence is due.

    Sorry, I should have clarified.

    I did receive them, however I 'misplaced' them. Does the same still apply?

    Edit: Just in case your reply is still do it, it mentions on their site there may be a small fee but does not mention the fee. Any ideas on what is the typical amount?

    Since 25 May 2018 and the introduction of the Data Protection Act 2018, there is no fee for submitting a Subject Access Request.
