Instructing a Solicitor

I am buying-out my siblings in purchasing the family home from my deceased parent's estate. The probate will shortly be completed.

Is it possible for the same solicitors to act for both me and our executor, my eldest sister? There is no contest and the transfer should be fairly simple. My own solicitor initially said this was not possible but my sister's solicitor said there wasn't a problem.

I have just emailed my solicitor to ask them to clarify their advice but thought I would ask here too.

    it practice it can be done - but it the best interest of both parties then best to avoid.
  • Are you getting finance or paying cash?

    If no, then one of you could be represented and the other could self represent
    If yes, then you will need a solicitor because your lender will want to know that the property has good and marketable title.
  • Paying cash...no lender...the price already agreed on the basis of the mean value of the valuations of 5 agents.
