Help with POPLA appeal

Hi All

In short ParkingEye rejected my first appeal due to insufficient evidence and have sent me a POPLA code. The appeal I'm writing is on the basis that there is insufficient signage in the pub car park the contravention is alleged to have taken place.

How should I go about evidencing this with photos? Do I take as many as possible or just the route the driver took in and through the carpark? Should I photograph the signs or will this build the case against me? etc etc? I think I have a good case because, genuinely, the driver tell me they didn't see the signs and going there myself they are very obscure.

Don't just use a single point appeal to POPLA

Read up on POPLA appeals in the Newbies faq thread near the top of the forum

#3 there covers advice on popla appeals with links to near templates to use
  • I am not using only one point but I feel the 'insufficient signage' angle is the strongest. I have read the section to which you refer and I seeking some additional advice re photographic evidence partiualr to my case.

IMHO, ParkingEye cases are almost never won on signage, unless it was dark/unlit.

Was the PCN a POFA version, served by day 15 and with the POFA/keeper liability para on the back?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The PCN does mention the POFA2012 and the very last paragraph does mention something about "the registered keeper" and it was issued after 6 days...

Is it worth getting on to the pub where the driver was a customer?

Why don't you have a look at some of the sample illustrated PoPLA appeals linked from post #3 of the NEWBIES FAQ sticky thread?
