Hi all,

i have spent the last few hours reading up online regarding PCN- however I'm slightly confused due to conflicting information as i understand every case is different so the advice given might also be different.

My situation:
i rent a flat in west london with my wife, i drive 3 cars on different days, and Parking & Property management LTD has been put in place in the last few months,

as i drive 3 cars i can't stick the parking permit to my windscreen but rather put it on my dash...

on this one occasion due to what ever reason the permit had fallen from the dash on the floor resulting in a fine...

i have contacted the company with an appeal (See below) however I'm rather worried as i read that 99% of the appeals get rejected.
if the appeal was to be REJECTED i would need help on what to do next.
is it best just to pay the fine and get on with my day or should i stand my ground and fight... if i was to refuse payment i would need some help on how to manage the situation and what steps to follow as i have ever gone down this route before...

To whom it may concern,

I would like to appeal the parking charge notice I received yesterday (5th November 2018) at 1.16pm.

I currently live at the address above and have a valid parking permit. Please see details of the permit below: (picture attached)

Issue : JULY 2018

I have been complying with the rules and regulations of the Parking & Property LTD and displaying the permit in my vehicle. However, I am unable to stick the permit to my windscreen as I drive 3 different cars on different days and only have 1 permit. Therefore, I leave the permit on the dashboard of the car I am driving on that day.

Unfortunately, on this occasion the permit had fallen down from the windscreen dash area and was on the floor of the car resulting in this penalty.

As I am resident of this property and have been since August 2017 and there has never been an issue before, I would greatly appreciate if the penalty could be revoked as it is unfortunate the parking permit had fallen down and the traffic warden did not see it.

In future, I will ensure that the parking permit in on the windscreen dash area in a way that avoids it falling down.

I look forward to hearing from you.

    It is not a fine, it is an invoice for damages for an alleged breach of contract, but do you have a contract with the PPC, that is doubtful, especially if they came on to the scene after you signed the AST.

    Do not worry about them rejecting your appeal, few people ever win these. It is what a judge says in court that matter. What does your AST say about parking and permits, does in mention "peaceful enjoyment?"

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised ccrime.

    Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by early in the New Year.

    You look to have used your real name in your post AND as your forum name


    You need to get MSE to change your forum name to something anonymous and edit your post to remove your name


    The ppcs monitor this forum and can use your posts against you


    You are correct in thinking the appeal will fail


    With IPC companies after an initial appeal you go into ignore mode. Ignore everything except a lbcca or court correspondence. They have 6 years to start legal proceedings against you

    It's hard to believe how someone who has:
    spent the last few hours reading up online regarding PCN
    Is still making such fundamental errors as calling it a fine/penalty etc.

    Follow the advice above, the "Newbies" thread is ALL you need.

    Why, and which idiots allowed that, or did the MA not even ask the residents? It's a scam, why would anyone allow this and accept a permit scheme at your own home?

    OP mentions a permit but I couldn't see a reference to own space
