Council tax court summons

Sorry if this is the wrong place to post. I have recieved a letter today to say I have been summoned to court for miss payment of council tax. I have never missed a payment and contacted the council straight away they asked if I was sure I didn't miss a payment so told them no and to check their system. They agreed that they could see on the system that I have made monthly payment on or around the 20th of each month and when I asked why I am getting this letter to pay £470 they said it is because I am on a weekly plan not a monthly plan. Has anyone else had this problem and more importantly do I have to pay even though I have made the monthly payments. Any help would be greatly appreciated

    You don't need to have missed a payment in respect of the overall monetary amount, the fact you have paid late is sufficient to lose the right to pay by instalments. By paying on the 20th you have missed two or three of the instalment dates in the month, that is sufficient to trigger the defaults.

    Prior to the summons you would have been sent at least one reminder notice that has not been complied with. Based on what you have said so far however the summons is correct,

    I always used to advise against weekly instalments as there's far more chance that payment can be missed - if you're on a monthly plan you can still pay weekly as long as the total value of the instalment is received by the council prior to the due date.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
