No control of Debit & Credit cards

in Credit cards
I have just found out that my Gym membership fee is still being taken from my bank, via my debit card info, even though I cancelled my membership.
My bank ( HSBC ) say that they cannot canx the gym request for the fee.
The payment is not down on my account as a DD or SO.
In theory they can request anything they like with no control from me.
The same thing can occur with credit cards too.
I have just canx my Debit card and asked for a replacement with a new number. Although I have heard that some banks still link the new card to the payment request.
Any views or recommendations from you guys out there.

Go back to the bank and tell them you're withdrawing your agreement to the CPA.
Cancelling the card won't help.0 -
As zx81 has said, it's probably a Continuous Payment Authority. You may be able to cancel it yourself in online banking, but as I'm not a HSBC customer I don't know if that's a function they offer. If not they should be able to cancel it over the phone.
They can't request anything they like - well they can, if they have your card details, but it would be an unauthorised transaction which would have to be refunded by the bank.0 -
As ZX81 says, get back on to HSBC and demand that they remove any CPA on your account which you do not know about.
I had this bother with them and it was only when I went in branch and made a fuss - with a lot of people watching - that they did anything. Phone help fobbed me off saying nothing can be done - they are wrong, you have the right to tell the bank to cancel and make sure it stays cancelled.
Also poit out that you told the company concerned months ago to cancel and you want any payments took since cancellation refunded.
If they still don't do anything then get the FCA involved.0 -
Just to add to the above posts, if a bank is resisting CPA cancellation, it may help to point them towards the FCA position on this at https://www.fca.org.uk/news/news-stories/continuous-payment-authorities-it-your-right-cancel:How to cancel a continuous payment authority
In most cases, you should be able to cancel by contacting the company taking the payment and asking it to stop. However, you do have the right to cancel directly with your card issuer. Once you have done this, it must stop payments immediately – it cannot insist that you agree this with the company taking the payment first.
REMEMBER: IT IS YOUR RIGHT TO CANCEL CONTINUOUS PAYMENT AUTHORITIES DIRECTLY WITH YOUR CARD ISSUER0 -
This is a longstanding issue with gym memberships... your contract with them will have a very specific cancellation process which if not met will result in them utilising the CPA.
Bank should be able to cancel this, although if gym dispute (due to contract) it would be set up again.
Not sure why D_M_E has suggested contacting FCA, they do not deal with individual complaints - if no success with bank, you would need to exhaust their complaints process and then take up with FOS0
