I have already called the Court to inform them of the situation and that the defence has been sent.
when acknowledging the claim on MCOL was it okay to tell them that the defence has been emailed directly to the court in the defence particulars box?
i saw that people on here have said leave it blank but it wouldnt let me continue with outputting something in there and the defence was over the amount of lines i was allowed to right in the box! (by quite a lot i might add)0 -

Perhaps you should ring the CCBC again and ask that they disregard the Defence you filed when doing the AoS and take your emailed one instead.

Which came first, the MCOL filling in of boxes, or emailing the actual defence?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Send the letter in post #29 then. No point asking for further time when you've prepared the defence. I'd send the letter JUST IN CASE there is an outstanding application for default judgment.
If your wording you put in the AoS box refers simply to your separately filed defence I can't imagine they're going to disregard the emailed version.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. I emailed the defence first much before I filled in the boxes for the acknowledgement (or what i thought was the acknowledgement)
I will try and call them now however i am unsure what to say because as KeithP mentioned it was an error and they may say I need to pay the fee to ammend it?0 -
No, ring the CCBC CONFIDENTLY, and say you emailed your full defence first, and as such that one takes precedence over the words you later put in on MCOL about the email already lodged.
Make sure the person on the other end says they have the emailed version as your defence as it was dated and received by the CCBC earlier, and ask them to assure you that the emailed PDF is the one that they will now share with the Claimant.
