BW Legal - Incorrect name

Hi all,

Like most posters on here, I am new to posting but have been reading the newbies sticky thread and other threads of BW Legal letters etc.

I am in the process of reading the PD actions on the Justice website and preparing to respond.

However, I have noticed that ALL correspondence from the original Britannia Parking letter, DRP letters and now BW Legal letter states my name incorrectly. For example, Jihn Doe rather than John Doe.

Am I clutching at straws to use this as an argument or perhaps an example of poor use of my data?

Kind Regards,
E

    Clutching at straws.

But what I would say is that in 99% of cases the name and address used is the one electronically lifted by the parking company from the DVLA and is more than likely the one shown on your V5C (logbook). Check there first.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

My thoughts initially, thinking back the PCN was in 2016 and the car at the time was registered to VW as a lease car, so they must've written to VW for my details - V5 was always VW Financial Services.

    But all irrelevant.

The misprinted name won't help the defendant win

    You say:
    ...and now BW Legal letter...
Tell us more about this BWL letter.

Is it a Letter of Claim?

    Does it suggest paying DRP?

    What exactly is it?

If you can't answer those questions, perhaps a picture of it might help.

But the facts of the scam probably will!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Hi,

I will get a picture and upload this evening when home.

I did try to decrypt their 'we want to help you' waffle. However, I think it's a Letter of Claim. Will post later,

    Thanks for your help.

A proper LBCCA will give you at least 30 days to pay and include forms for you to fill in and return (though you are not advised to do so!!)

I hope the attached works, remove the z's and replace accordingly :)

    Thanks again.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised ccrime.

Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by early in the New Year.
You never know how far you can go until you go too far.

Debt collector letter from BWLegal adding a fake £60 yet again

Court proceedings ???? BWLegal are making the wrong assumption they will win ....... When you win, you claim costs against them

Next will be a LBA giving you full proof of their claim and with 30 days to respond ..... come back here if you receive that
