  • Damage charges must be authorised by the cardholder at the point the damage claim arises which is the point the vehicle is returned. Car hire companies can’t just use the pre-authorisation to cover damage costs. Not sure if this is a rule that’s changed over the years but there are specific chargebacks for it.

    Thanks for the knowledge update. In the bad old days all the rental co had to do was provide an assessment of the damage and an estimate of repair costs by a garage authorised to do such things, together with proof that the customer agreed to pay for such charges - either up front or at the time.

    You wouldn't believe the hassle we used to go through with customers charged for damage and the endless attempts we made to get the rules changed to prevent this from happening. Seems like the world has finally agreed to accept change - albeit a couple of decades late!

    I think the biggest reason why rule changes were so hard to come by was that Visa was so keen to be seen as the preferred card with T&E retailers (not sure about MasterCard) that they bent over backwards in favour of what was best for the retailers.

    Can you confirm that this applies in the UK, the EU and Inter-regionally?

    The rules apply for both Visa and MasterCard issuers and are worldwide.

    You would be right - the cards world was a very different place then.
  • Hi..need help please.
    we brought some holiday weeks off a company in gran canaria called enduria travel. ( please dont go into why did we do it etc, thats irrelevant now).
    problem is we paid by debit card in november 2017. the company couldnt give us what they promised when we tried to book these holidays therefore us ending up not using the weeks we had purchased. it turns out that enduria have now gone bust earlier in this year.
    how do i get monies back. ive contacted yorkshire bank but they wont help cause its past the 120 days time limit. but i keep reading that you can have upto 540 days if the goods were used at a later date. the bank wont accept it....

    by the way, im not on our own with this... theres loads of others struggling too.
  • Not really relevant to this thread but if you are not getting a service that you have paid for by card you generally have a right to dispute the transaction through your card company. They will probably ask you to try and resolve the matter with the retailer/liquidator first.

    Rules have changed since I worked in cards but you would expect to have 120 days from the date the services became unavailable to get a Chargeback processed and your Chargeback amount will be limited to the portion of services not received.

    I have a suspicion that the 540 day limit from the original transaction (which never existed in my days in cards but had been talked about) is an absolute maximum. So, as long as you are within 120 days of the service cessation and 540 days of the original transaction a Chargeback may be considered (subject to the Chargeback requirements, of course).

    You haven't been specific with the date the company went bust but it does sound like it was more than 120 days ago. You may argue that you didn't know of the liquidation until more recently but, if you are not within the Chargeback time limits and have no other rights due to paying by debit card, you are probably out of luck and will have to take the matter up with the liquidator to see if there is any money available for you - don't hold your breath.

    Sorry. If anyone else can give more clarity to the Chargeback position, please do so.
