HELP PLEASE - Do I need to act on a Letter of Claim BW Legal?

    Not really, they all use different words. I wish it was that simple!

    The way to tell if it's intended as a 'real' pre-court letter, is whether it gives 30 days and includes the PAP reply forms.

    This letter is title "Letter of Claim" but it clearly states that I have until the 2nd of December to Respond or they will instruct a claim.

    "If payment or a response is not received before 2 December 2018, we are instructed to issue a claim against you in the county court without further notice. If you dispute this debt, please tell us why"

    Therefore, the big question is do I just write a simple letter back denying the debt?

    But, they have given 30 days, and included the PAP reply forms,

    There seems to be alot of holes in their argument for the "invoice"!

    Yes and asking them to put the litigation on hold, given that their client refused to provide some of the letters in the previous SAR, under the weak excuse that they related to a different named person (even though it's your car/you are the potential Defendant). And now that person has sent another SAR to their client, and thus you require a 30 day restriction of data processing, whilst that SAR wheedles out the missing letters their client knowingly withheld from you.

    you issue a rebuttal (denial of debt etc) and dont send their forms back

  • Hello, am just writing the holding letter on this, and was looking back through old information and came across this, wondered if it is useful to the case?

    on 9 Nov 2015, UKPPO stopped being members of the AOS Scheme and the BPA confirmed that they could no longer use the AOS logo. I have photographic evidence from May 2016 that they were still using the AOS logo on signs at newcastle airport - any use or not?

    Also, replies on the SAR are weak and they have sent very little information, and will not confirm if they have sent any of the keepers / my details to any other company.

    Yes you could make use of the fact they failed to remove the BPA roundel, albeit it is a small point.
    Also, replies on the SAR are weak and they have sent very little information, and will not confirm if they have sent any of the keepers / my details to any other company.
    So now make a complaint to the ICO:

    another question, is it legal for BW to run a credit check on the registered keeper of the vehicle? They have done this so want to see where we stand, or is it ok for them to do this at this stage?

    Probably just a check on an address. Not a check on your creditworthiness.
