Letter Before Claim Letter

I have responded robustly to a LBC going back to early September requesting lots of info.As yet I have not received a response. I gather they have 30 days to reply. Simple question - I know this letter is meant to be start of legal process but I there any onus on the claimant to take action following this letter within a timescale please?

    As long as they allow you the minimum time to pay (30 days) there is no limit on how long they take to issue the Claim
  • Thanks for your help. Surely a judge would ask questions if a claim was raised later with no obvious reason? Does this mean the claimant still has another what 5 years to claim even though letter has been raised now? To be honest slightly irked as I am convinced not only have I a winning defence I was hoping to turn the tables.
    Sorry, another question- does the original landowner/tenant have a financial interest in number or parking tickets raised?

    The statute of limitations is 6 years. There is no negative to using the full 6 years.

    They might do. You would need to inspect the contract to find out.
  • Thanks for that. Fat chance of seeing the contract any time soon. My copy of protocol states on section 5,2 that if the creditor requests information this should be sent with 30 days or explanation why this is not possible. Should I be chasing?

    I'd have sent a SAR directly to the parking firm's Data Protection officer (see their privacy page online for contact details) not just a letter to a solicitor, if I read that right (I am guessing it's via a solicitor but some don't use one).

    It's entirely up to the Claimant.

    Some will issue a claim as soon as the thirty days are up, some will take their time, and some will not even bother issuing a claim - treating the LBC as just another threatening letter.
