I hope I can write this in a way that makes sense! Until earlier this year I worked night shifts with a home care company. After I left I discovered their night shifts were paid from 10pm until 7am, the shift I worked was from 10pm to 9am, I was paid the night shift rate plus one hour so essentially I was paid until 8am as per their contract. I have contacted the office about this and either been told that’s just the way it is or ignored. By my calculations it’s at least £1,700. I have nothing in writing about this particular client going against their contracted hours, nor do I recall being advised of this at any time. Surely, they have to rota and pay by the contract they provide which means they owe me one hour per shift worked? If I am correct in this belief could anyone please advise me on how to go about claiming this as they’re clearly not going to assist me in an amicable and easy solution? I am unfortunately not part of any union, I have looked through the forum but can’t find anything relevant. Apologies if I’ve missed it.

It's not clear. What you worked isn't relevant. What were your contracted hours with your employer? If you worked other hours, that's on you. Who told you to work 10 pm - 9 am?0

I was asked to work 10pm until 9am. The first chunk was a night shift and paid as one sum, after that it was hourly. Their contract states night shifts end at 7am0

I have Rita’s for every night I worked showing the hours as 10pm to 9am. I also have the contract/hours/pay breakdown0

Any unpaid breaks? An hour "lunch" and 2 half hour "tea breaks" could account for the 2 hour shortfall....0

You could do with checking your contract to see if they pay for breaks, or if these are unpaid. You can claim for deductions of pay (this includes underpayment) in the county court but there's a process that you need to follow first (as well as checking your contract), have you been to the CAB, or are you in a Union?0

No unpaid breaks as it was 1 to 1 and I was alone the whole time.
How do I do a money claim please?
I haven’t yet been to CAB as I was hoping to resolve as rapidly as possible myself, sadly no union and unsure if I could join one now and ask for help for then0 -

It costs £115 to make a claim for £1700, the fee is added on to the claim amount so if you win you'd get £1815 back (assuming they pay, which isn't a foregone conclusion).0 -
How come you have 'only just noticed' after you have left. Would you not have realised that your wage hours paid did not match your hours worked on your payslips?0
