    Appeal to PoPLA with the information you already have. When they respond, you will be given 7 days to rebut any evidence they have. If there are photos, you will get to see them then and can comment on them at that point.

    I wouldn't bother 'phoning PoPLA.

    Let us know what the ICO says. The keeper has sent an SAR. The scammers are required to provide information about the keeper that they hold.

    Nobody else is involved and the scammers have no business suggesting otherwise.

    Have just received acknowledgment of my appeal. Now less stress over Christmas ( if small grandchildren behave - fat chance).

    Email today from POPLA saying photos now available and asking for 10 digit verification number & password .
    "You can find your verification code on the rejection notice sent to you by the private parking operator."
    Looking at the correspondence I can find no 10 digit number. If I put 0000 before my PCN number it makes 10 digits, but it is rejected.
    I have just emailed PP to ask for the 10 digit number to be sent swiftly as I have only 7 days from 9 January to access the photos PP and respond to POPLA.
    Christmas was as stress free as is possible with two 7 years old boys:wink:

    The 10 digit code is the POPLA code you used when you filed the POPLA appeal, the one from the parking firm's rejection letter.

    The password is the one POPLA emailed to you, which you use to access the Portal. They emailed you an immediately acknowledgement when you submitted your POPLA appeal.

    This should be (and is) an easy stage. Surely you have your POPLA code at the top of your POPLA appeal, you must have put it at the top of your PDF?

    You do know the POPLA code, you had it in order to submit the POPLA appeal in the first place.

    Coupon-mad. Thanks for your speedy & helpful response. Apols for delay in replying, no computer access till 16:30.
    I've just visited the POPLA site. I had asked for all photos relating to my PCN, including any of occupants leaving the car park. No new ones were supplied (Just the two photos of an empty car & one of signage).
    They say
    "We have enclosed a witness statement from our operative taken at the time of issuing the PCN abcd.
    I observed the driver parking, then leaving the site going in the direction of the town centre. It was a male driver with grey hair wearing a dark jacket, grey trousers and with a green rucksack.
    Parking Enforcement Operative ID Number abcd"
    I've not quoted the PCN number nor the Operative's ID number for confidentiality.
    In the 25 pages there is a line to say that their operatives do not warn possible offenders for the operative's protection!
    Your comments & thoughts on my next steps will, as always, be greatly valued.

    Don't tell me...PP haven't trawled your Social Media and found what you look like?

    I wonder if they are trying to intimidate you with that description?

    Really - don't tell us whether this describes you, but I would not put it past a firm who (reportedly) send a pm on this forum to a Defendant in a claim, telling him they would use his forum thread against him, and basically coming across as intimidatory. He ignored them and carried on defending!

    Parking 'employees' (obviously desperately looking for a real job in life) don't have a duty to mitigate loss that POPLA will take into account. So forget that.

    I would be uploading your 2000-character comments on this evidence, briefly pointing out that this has become a 'he said, she said' matter and PP have shown no evidence that the person described was the driver of this car, or that this person left the site (no evidence) and you do not recognise the description as matching any driver of this car, all of whom are bald or female...

    And point out to POPLA that a purported WS from a supposed employee of this rogue industry is all very well, but in fact your own statement of case carries no less weight than the supposed 'warden' who has astonishing and very convenient powers of recall, given that his job every day involves hiding and watching people leave their cars for him to swoop with a PCN.

    Realistically, it would be impossible to recall and describe a person thus without notes & photos of the person taken that day, showing this person at/getting out of the driver's seat of this car (conspicuously not provided to POPLA) and you suspect foul play.

    There is no evidence of any compelling corroborated notes/photos taken on the day so their lack of evidence and dodgy (much later) 'WS' about a grey haired person is laughable. No new photos were supplied, just 2 photos of an empty car & one of signs.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
