Hello all I'm in need of some help, I got a parking fine for 100 but can pay 60 by the 6th Nov but I think I should appeal on this basis
Date of event was 29th Sept, date issued is 24th Oct.. Apparently they wrote to the registered keeper who's details were kept by dvla at the time of the parking event and was told I am responsible for the vehicle. The trouble is this.. They have my surname wrong.. Its close but its wrong. I have sent a email to the dvla asking when PE requested information.
I'm confused tbh is the Pcn out of time?

Please read the sticky thread for NEWBIES, then send the appeal template you will find there in post 1.
You can add, carefully without revealing the identity of the driver, that since the NTK was issued too late to transfer liability to the Keeper, they should cancel now and save themselves the effort.
This may have no effect so it's up to you whether you modify the template, but
don't make any other changes.

From what you say they have been told you were driving by the keeper
The delay in sending you the PCN is irrelevant as is the spelling of your surname0 -
Are you the registered keeper of the vehicle?
If so, the NtK might be outside of the requirements of the Protection of Freedoms Act 2012 to hold the keeper liable.
Does the reverse page of your Notice to Keeper (NtK) contain a paragraph about the Protection of Freedoms Act 2012, which commences 'You are notified under paragraph 9(2)(b) of Schedule 4 ..... '. And a further paragraph which commences ' You are warned that if, after 29 days from the date given ....'?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
