Faulty New Car on PCP

Hi,

Looking for some advice.....
I have SE 95 polo in the off white colour with black roof and wing mirrors. I love the colour and how it drives but it’s got many problems. It been in the dealership once before, it currently back in the dealership and I had the following answers from them via a video and text. No phone call.

Front assist- comes on randomly including at high speed driving on a dual carriageway and at junctions and on speed bumps at low speeds. :arrow: can’t fault, even descriptions have been given. Video evidence been provide, offered to show technician but no time given. Kept saying nothing wrong with ACC, I only have a speed limiter on the car. They have said that the front assist does not need recalibrating, I have video evidence of a technician saying I’m going to try get this to recalibrate and proceeding for up to 1 and half hours to recalibrate the front assist

Wipers - both front and rear made a terrible high pitch and juttering across the screen, not clearing the screen so I have to pull over if it starts raining too heavy. :first time cleaned them and said diamondbrite on the screen which I’ve not had. This visit apparently replace front wipers and clean back wipers. Told I would have to live with this issue and “replaced” wipers are black when you run your fingers along with dirty.

Handbrake- have to properly pull it up a good few clicks to get it to stick on, it comes off occasionally on hills. told they had these polos in with same issue, even stripped down made no difference to the issue. They put it down to moisture in the drums. They haven’t even done anything to investigate the issue and have warned it will get worse in winter so basically I can’t park on a hills.

Stereo- screen freezes goes black, whilst using Apple car play the call a long beep happens (I’m in a good signal area) and I can’t hear the person speaking but they can hear you. two updates available not done as don’t think it will sort it and submitted techinal report to VW- also told it could be my phone that’s out of date, my phone worked fine on courtesy car.

Seatbelt recall and replacement of damaged on delivery front passenger door seal. Identified on first visit to be replaced on second visit (visit being used for futhur diagnostics on electrical issues as a suitable technician was not in on day but still told to bring my car in) not completed and identify what’s wrong again and action to be right.

The dealership took the courtesy car off me on 25th September, we been told many different stories by dealership which is why we went to reject the vehicle on 13th September. The dealership has told the VWFS they can’t find a fault and they won’t take into consideration the evidence we have of the faults, the proof of lies been told to us by the dealership. VWFS have basically said it’s not serious enough to be a rejection! A car breaking at 70mph and causing an accident is not serious enough! They taken over 5 weeks to investigate this and my case handler only rang me back when I demanded to speak to a manager. She said I can take to another dealership but it would still have to go back original dealership if a fault is found.
As the faults appeared in the first 30 days, I was rejecting under the consumer rights act.
Compare to the same model of courtesy car, no fault with the courtesy car but these issues with mine proving there is a problems with my car.
I have booked the vehicle in at another dealership but don’t feel safe driving the vehicle and I’m not sure if taking the vehicle would affect my right to reject?

Does anyone have any advice at all? Any one can recommend a solicitor it would be much appreciated too.

    Schools out still?

    So the wipers get dirty? Stop using them on a dirty screen.

    Handbrake needs to be applied firmly? Apply it firmly and it works as intended.

    Stereo? Try a better phone

    Front assist, comes on? Clean the sensors?

    How often do you wash the car?

    First of all, I work full time, I need the car to get to and from work and have family members who depend on me to get around.

    The wipers jump across the screen, not clearing properly because of this they make a terrible noise. This was happening from new.

    Even when applied firmly, it rolls so you need to put into gear to prevent movement.

    The car is washed regularly, it’s a brand new car so it’s looked after especially after the money I paid out each month for it. I wouldn’t just not look after it. I was brought up to look after my belongings. I work hard for my money so when I spend money on something I’m not just going to not look after it, I might as well throw money down the drain!

    The front assist comes on when you are driving on a normal straight road, say if you were in front and turn into another road, clear the junction my car still thinks you are there and emergency brakes nearly causing people to go into the back of me. Something I have no control over.

    My phone runs the most update software and works fine on the courtesy car so why shouldn’t it work with my car? Both cars have exactly the same system.

    Thanks for your very lovely response, it’s been most helpful.... you try being without a your car and still paying for it or be driving around in car that brakes unexpectedly nearly killing you on busy dual carriageway and see how you feel. I’m sure you would love to drive it!

    Are you sure you havent got to close the car before it has turned or have i misunderstood.


    and has it come on a dual carriageway at speed? it is only supposed to work below a certain speed (is it about 15mph) if it comes on at that speed it wouldnt nearly kill you, of course if it comes on when doing 70 thats different.

    They told you its whatever chemicals your using in the wash. Its a minor issue.

    Drums expand when hot. Are you applying it properly? Cant see a garage saying yeah the handbrakes dont work on all these cars and sending you on your way.

    I don't see anything where the OP says they were told this. The dealer said it was DiamondBrite - OP confirms that this was not applied therefore was a false statement.

    OP - I feel the responses you have received are overly-critical. IMHO the failure of the Front Assist mechanism alone is a serious fault - if it wasn't then why would they spend all that time trying to fix it?

    You have a good case to reject the vehicle as it has already had one repair attempt and yet the goods still don't conform to contract. (Consumer Rights Act 2015). As it is in a finance contract (PCP) then you can approach both the dealer and the finance company (via a section 75 claim) to reject the vehicle for a refund - the only caveat is that you would have to stop using it if you take this course.
