Parking Charge Notice

My wife has received a Parking Fine from Parking Eye of £70 (reducing to £40 if paid in 14 days) for parking in an Asda car park for 3 hours and 3 mins when free car parking is restricted to 2 hours. They have sent photographic evidence. Despite the notices on site she didn't realise she had to purchase a parking ticket. It seems a very excessive fine and I wanted to clarify if they can legitimately claim the sum they are demanding and whether they can legally prosecute if it is not paid.

    It's not a "fine", and they can't "prosecute" anyone.


    However they can, and do use the small claims court, but you will understand all that after reading the newbies thread.

    Complain to the Asda manager (not Customer Services) and get him/her to cancel. Take receipts or bank/cc statements to prove regular patronage and purchases on the day. The manager has direct computer access to the PE system to effect cancellations. Be firm, but polite.

    google the name BARRY BEAVIS to see what PE can do in civil court against motorists who "overstay"

    his last loss was 2 years ago in the Supreme Court in London


    its not a "fine", its an INVOICE


    and they dont "prosecute" , they issue court claims in the county court, starting by using the MCOL website (google it)

    My response would be directed at the CEO of Asda

    Dear Sir,

    I have recently received a parking ticket from your agent, they being Parking Eye. This is because I overstayed in the car park park by one hour ? So what if I did, I was shopping in Asda ?
    As a customer, one would think you would respect that the longer I shop, the more profit you make. ?
    But no, you restrict your customers to 2 hours and by doing this, you are losing profits. A very odd way to run a business.

    I must assume therefore that with christmas spending getting near, you would like all my spending money but, how could that be when you restrict people with a 2 hour limit and in particular, a well known parking company who gets into the press on a regular basis, and probably earns more money than you do, scamming your customers.

    Let's say I have £300 to spend ? Your system dictates that I only have the time to spend £150 so you are saying to me, to go spend the other £150 somewhere else.

    I trust you can see how futile your system is, and the problem is, you will never know how many customers are doing the same.

    It's your choice and my money and I request you get this futile parking ticket cancelled and if not, explain to me why you no longer want my business
