Light fitting or shade?

When I moved into my latest property I found that the seller had removed 9 ceiling lights (mainly chandeliers and 3 lamp decorative pendant fittings) and replaced them with cheap plastic single bulb fittings (without bulbs). Some of the original light fittings were shown in the sales brochure and I saw them when I viewed the property. The seller claimed that the ceiling lights were actually shades which could be removed without my knowledge. Am I missing something?

    What did it say in the fixtures and fittings list?
  • As cakeguts asks, what was declared in the property info form that the seller filled out at the start of the conveyencing process? There are specific questions on light fittings.
    I took 2 nice light fittings and replaced with single bulb fittings when I sold. I wanted the fittings for my new house. But I declared this on the form.
  • No mention was made of light fittings at any time during the conveyancing process (Scotland).

    Maybe not while you were paying attention, but they were almost certainly mentioned in your offer.

    If your solicitor was using the Scottish Standard Clauses then your offer would have included:

    "1.1.4 the following insofar as any were in the Property when viewed by the Purchaser:...electric light fittings (including all fluorescent lighting, external lighting, wall lights, dimmer switches and bulbs and bulb holders but not shades)"

    So they should have been left, unless the seller had qualified that clause somehow in their acceptance (or unless they really were just shades).

    Whether it's worthwhile pursuing is another question. Your loss is, at most, whatever some secondhand lightfittings are worth.
  • Thanks for you comments Davidmcn. I'm sorry, I meant that the ceiling light did not come up in the missives but I agree that light fittings and shades are included in the Scottish Standard Clauses as fixtures and removable items respectively and the SSCs form part of the contract.

    I and my conveyancing solicitor agreed that the chandeliers etc should not have been removed, so I claimed compensation from the seller in the Scottish small claims court (called Simple Procedure but it was quite formal). To my surprise the seller claimed the ceiling lights were shades and the presiding Sheriff agreed, so I got nothing!

    I wonder if anyone can explain to me how a ceiling light connected to the electrical supply and screwed to the ceiling can be interpreted as a shade?
