Hi..
The driver didn't see any signs that stated there was a 2 hour limit nor any indication that ANPR was in use. I have received a PCN from Parking Eye.
Using Google Street view to retrace the drive it is noticeable that the signs are very small (you wouldn't be able to read the information from a car in motion, you wouldn't see them at night) most are obscured by trees.
They are at 90° to the road and are not illuminated.
There is no sign before the camera warning that it is used, so there is no option not to have your data taken. This is a breach of GDPR.
Because they have no auditable evidence of a keeper having given their express consent for the processing of their information in this manner, they have no right to that data and I as keeper can request its erasure.
Ideas, thoughts, help all will be appreciated.

    Start by editing your post to remove information about who did what. Only ever refer to The Driver and The Keeper. This is explained in the NEWBIES thread that you claim to have read.

    Unfortunately the DVLA, who supply the keeper's details to the scammers, have different ideas to you about releasing data. I doubt you will get any traction with regard to that.

    Just follow the tried and tested process of sending the initial template from the NEWBIES, then appealing to PoPLA if/when it is rejected. Inadequate signage would be one of several appeal points.

    Do you have a "golden ticket"?

    Have you complained to the service station manager yet, pointing out that MSAs are refuges for tired drivers? The UK Government tells people not to drive under those circumstances so you should be emphasising how dangerous it would have been for The Driver to continue their journey without taking a sufficient rest period.

    Have you complained to your MP about this unregulated scam?

    Your first sentence tells us you have read the NEWBIES.

    Did you read that part of the first post of the NEWBIES thread which says:

    Your second sentence tells the world who the driver is.

    There is no place for the word 'I' when describing events on the day.

    The PPCs trawl this forum just waiting for people to trip themselves up and can use your posts against you.

    Please edit your post accordingly.
  • Ok, calm down this post was for the forums benefit & has no bearing on the appeal I will send in -all keeper I promise.
    Thanks for the point about service stations being a refuge for tired drivers, they should be able to stay until they are ready to continue the journey.

    You can find a POPLA appeal to copy in due course, by searching something like:

    ParkingEye MSA unlit signs POPLA

    MSA POPLA as your keywords, as an alternative, will show you all Motorway Service Area POPLA appeals, unlit signs or not.

    Parking scammers read these fora and have used information from here both at appeals stage and in court.

    Initially you posted enough information for the scammers to identify the driver. Even now, it is debatable whether the driver is anonymous. Parking Lie could suggest the information you have left even after you edited is enough for a judge to assume they know the identity of the driver on the balance of probabilities. The Keeper can very probably be identified from your post, and it only takes one careless "first person singular" to blow your toes off.

    It's up to you whether you take the advice of volunteers who have been doing this for years, or whether you dismiss our comments with mild insults.

    Personally I don't think you have done enough to ensure the driver can't be identified. The person who didn't see the signs was The Driver.

  • The FAQ says not to indicate who is the driver - I didn't realise that meant across, what I thought was a friendly forum, I assumed that meant in correspondence with PE. Even then without dates or exact times and with an anonymous user name, I thought I was pretty safe.
    I am sorry if anyone felt mildly insulted, I don't work that way, if I wanted to insult I would be full on, so any slight felt was & is unintentional.
    I mainly wanted to see if there was any point in chasing the GDPR route as the signage doesn't comply, ANPR is still CCTV.
    Other threads say to avoid "rants" and the second part of the standard template is most definitely a rant.
    Anyway I didn't come here to cause conflict or problems, I have found a suitable template to follow so I will use that & leave you all in peace.

    The reason we warn people is because parking firms read this forum, it is successful so they trawl it and have been known to try to use printed out forum postings against defendants, especially if the forum post says who was driving, but the appeal denies it.

    So beware of parking firms here reading your words!

    I hope Smart Parking read this and are aware of the demonstration that took part last week in the town next to us.

    The Major, councillors and others were there.

    Everyone is complaining about you,

    The economy of the town is being affected.

    Many will simply not park in that car park anymore, including myself.

    When will you listen???
