Smart Parking PCN

I'm really glad I have found this site and the Newbies section has been invaluable. Having received a PCN (my first ever) from Smart parking for a 24 minute overstay at my local retail park, the PCN had ANPR pictures of my arrival & departure. My first reaction was anger and then I thought I would just ignore it and it would go away. A friend on Facebook has said they did the same and on 2 previous occasions they did not hear anything, but on a third occasion they were pursued, taken to court and lost, presumeably bacuase of the precedent set in the Beavis case.


Anyway, I was unaware of any parking restriction at this retail park even having visited it many many times over 20 years. I had a weeks holiday and it was time to buy and look at things that I do not normally get time to do. So time was spent in B&Q looking at tiles and bathroon fittings which took a while. Then some shopping at Aldi, followed by lunch at M&S, a visit to Home Bargains and back to B&Q to buy more stuff. All told I spent over £350 during my visit. Naturally I was angry having the audacity to put money in the tills of these outlets and be penalised for it.


I have since been back to B&Q (as that was where I spent the most) and spoke to a manger who took the details and said that they would email Smart Parking concerning this, but could not guarantee any outcome.


I was simply going to reject the PCN with copies of my various receipts and copies of credit card transactions and hope that would suffice. However, having read these forums, I am now guessing that they will still insist that I pay it. Therefore, I will use the rejection template on this forum, but should I also include receipts as back up, or just use the template on its own.


Any help or advice would be appreciated.

    You can attach copies of receipts, but be careful you don't say something daft like 'here's proof why I was parked there for a little longer than 3 hours'. No identification of the driver please!

    Why, when sending JUST the forum template appeal from the KEEPER, sees Smart cancel every time within 40 days?

    Don't blow it. Don't reinvent the wheel...

  • Right then. Challenge template now sent. Keeping fingers crossed...
  • Update on this one. B&Q did email Smart Parking concerning this ticket, but apprently they have replied to B&Q stating that they will not consider cancelling the PCN and that they would only accept an appeal from me, which I have already done. I'll just have to hope that the template letter will have more success.

    Have you complained to any of the other retail managers? There is a retail park near me where a manager from any of the stores there can get a PCN cancelled.

    Have you complained to your MP yet about being penalised for supporting the local economy?

    Did this take place in England, Wales, Scotland or Northern Ireland?

    My initial complaint was to B&Q as that was where I spent the most money during my visit. But as Smart Parking told B&Q to 'politely' go away, I'm sure that they would tell the others the same. I haven't contacted my local MP yet, but I will do.

  • Update on my PCN from Smart Parking. I emailed the template letter with my rejection in the hope that it would work. Well, today I received an email from Smart Parking to say that the PCN had been cancelled :j

    So pleased with the outcome and would to thank all concerned on this wonderful site without whom I would have probably ended up paying.
