Hi was wondering if anyone could help. I'm sorting out a possible overpayment of universal credit but before I submit all my documents i have a query. I claimed UC last a August 2017 after I had to leave my job due to ill health. But I've now noticed my p45 is dated end of October 2017Does this matter? Do my former employees have to correct it? I have emails with the correct resignation date . Thank you

I think the chance of you getting it amended given the length of time that has elapsed is very small. It will have been copied to HMRC at the time it was issued. You can always give DWP an explanatory note with copies of the emails you refer to.

From a UC point of view it may not matter anyway. You can claim UC while working so whether you were employed or not is not likely to make a difference. When calculating your entitlement to UC any earnings are taken account of on the day they are paid regardless of when they were earned.

Do you know how the potential overpayment has occurred? With more information we may be able to work out whether the P45 date could make a difference.

Sorry I'm getting myself worked up. I've had depression anxiety and bulimia for years. After my overdose i was assessed again and now diagnosed with borderline personality disorder and ocd. Life just seems to much right now and I cannot cope with all this. Had a breakdown at the job centre and panic attack trying to explain everything and the community mental health team were calked. Since then talked to work coach who said write down my concerns and post to journal with any documents. I'm in work preparation group if makes any difference. From looking online i may need to pay back the first month UC if my last wages are taken into account. Also the month where I attended uni for 1 day (it was a part time masters with pg loan, I read 30% of loan taken into account for UC and stops being taken into account for UC when course ends or student leaves the course so assuming I would have to pay back that month too)
Scared I'm going to b e in lots of trouble. Once again please don't quote any of my posts please

I now recall your earlier threads and I don’t wish to go over the same ground again. I only asked in case there was something I had overlooked when thinking about the P45.

Please don’t worry about the P45. I don’t think it’s material. Sensible just to include emails about leaving as well as the P45. Nothing you have now added changes my initial opinion that the leaving date is unimportant to your UC entitlement.

In terms of your final wages I don’t think they will be counted.
You claimed on 14th August 2017. Because of the 7 day waiting period that applied at that time your entitlement to UC did not start until 21st August which will have been the start of your fists assessment period. If wages received on 18th August they are before the start of the assessment period and should be ignored.
