  • Are you sure the letter wasn’t a court order asking you to pay?

Yeah 100% as I was happy to set direct debit up but was too close to pay day so she set it up for the following month
  • You need to re-read the letter and confirm exactly what it says.

Also how do you know the CCJ is for this loan?

It doesn’t state on your credit files what the loan is for.

It sounds to me like you admitted the debt and made an offer for payment - this will be what the CCJ reflects (the claimant would have requested judgment based on the terms of your agreement to protect their position).

Have you got anything in writing which confirms that they would discontinue the county court claim based on your agreement? I'd be very surprised if you did.

It says on a full credit report who it's for, dates match up and so does the amount minus the court fees which were stated in the original letter from Morton Frazer.
I've never paid court fees. The letter from Morton Frazer solicitor also says to avoid court to get in touch to arrange a payment plan
As originally stated thanks for the help in this much appreciated I have fought so hard to get my rating up and wondered why it wasn't going up anymore hence why I requested full credit report in free trial with experian.... No other ones like clear score or noodle or totally money have it on it

Are you sure that it's a CCJ and not just a default? With a CCJ you would normally see a case number and not who it's for.

Yeah it's under adverse activity CCJs and the amount matches the amount due back minus court fees which I say never had to pay. It has reference number not who its against but tjats the only thing I've ever been challenged on for court
  • Sounds to me like you’re paying off the CCJ then and that’s what the payment plan was setup for

Even if this was agreed at minimum 2 weeks before the court date? I mean they said I was to get in touch to arrange repayment to aVoid court
  • If they had already started the CCJ then you would have had to have it set aside at the time.

    Phone them tomorrow and check
