Sorry, wasn’t expecting to be here so soon, however we had a court date through the post today and I haven’t even handed the witness statement in yet, it’s not due for about 10 days, is that normal procedure? I thought that one come once the ws was received by them?0
-
I expected that court date with the previous letter, and I did tell you about it so that when it came you diarise 18 days prior to that court date in order to submit the non-attendance letter to court and to claimant
maybe they forgot to enclose it in the previous letter ?
maybe they are doing things slightly differently ?
maybe its a red tape issue ?
dont know, dont care
just submit the WS and pics when you need to in 7 to 10 days time, then submit the non-attendance letters on time too
at least you can diarise all the dates now with your various deadlines0 -
Usually the deadline for sending in the witness statement and other evidence is set in realtion to the court hearing date, in teh same letter.0

Ah ok, sorry I just thought that came after they had my reply sorry misunderstood that bit but yes I do get the 18 day bit and in the diary and I’ll be ready for that thank you.0

no , as post #234 above told you, it all usually comes in the same envelope, which was why we could not understand why it was missing yet you had the WS and exhibits date letter , so perhaps they could not supply the actual court date but had to get the WS letter out regardless (maybe they were waiting for availability of a judge or courtroom ? we shall probably never know)
assume you got them all on the same day in the same envelope and plan ahead as I said, because those 2 deadline dates are your important markers (not red tape paperwork on if , why , but , how questions , lol)0 -
Hi again, I’m very sorry to ask but do I return the W/S to Gladstones as opposed to pcm? I’m assuming I do but would rather be safe than sorry. Thank you0

Sorry found in previous post thank you!!0

Yep, youre comunicating with their solicitor always
You also need to include the bundle of yoru evidence, not just the WS. The complete file that goes to the court.0 -
Finally... the case against Gladstones came to court, I did as I was advised and hubby wrote a letter asking for the case to be heard on papers, today I received a letter saying WE WON, they didn’t have enough evidence of signage that was up unlike,e myself who took photos, and freedoms act error etc, I can’t thank those that took the time to help me enough, you are life savers and I am eternally grateful.0
