Refund after dro sent to closed account.

Hi..i had a D.R.O. in 2016 with moratium period finishing in sept 2017..i had a credit card in 2009 with m.b.n.a but eventually the debt was sold on to Arrow Global'and then Capquest..however..today ive received a letter from mbna notifying me of a refund for charges of 600+..theyve sent it to arrow global to credit my account which i no longer have as it went on to capquest and ended up in the D.R.O...what should i do please??

My take on this is that they cannot credit against a debt that does not exist, and that the £600 is yours. However it may now take a bit of work to get the money back and I don't know how much effort you want to put into it.

As a first step I would write to MBNA and point out that you were discharged from any liability to Arrow Global in September 2017, and quote

insolvency Act 1986 s251I

Discharge from qualifying debts

(1) Subject as follows, at the end of the moratorium applicable to a debt relief order the debtor is discharged from all the qualifying debts specified in the order (including all interest, penalties and other sums which may have become payable in relation to those debts since the application date).

As there is no routine letter sent when the DRO completes they may want to see proof. The DRO Team can provide proof if you need it.

There's no danger of this affecting your DRO as (a) it was not a quantified sum at the start of the DRO

(b) it's less than 1k
