Guys Dad
I've copied the blue appeal bit from the link you said but there's a bit further down that thread that's confusing me about being disabled.
You said my personal circumstances have no bearing on this matter but I thought being disabled/having a BB was relevant as the bit at the bottom of that link, after the template in blue which send to them unaltered, says to add details to the first appeal if one of the occupants has a disability?
It reads...
"You can (carefully!) add a little to the template above, 'in order to resolve the dispute I attach copies of...':"
Then below that it says..
"If an occupant of the car is disabled or elderly/infirm, then the keeper can add that, without implying who was driving. A copy of the Blue Badge (BB) is a good idea to upload/attach, but a person with a long-term debilitating condition (not a broken arm!) can be disabled without a BB, and will be legally entitled to a 'reasonable adjustment'. That can and should include an extension of time, over and above free or paid-for parking time."
I'm not sure quite how I put it correctly. Do I say that I was feeling poorly that day/explain I have Lupus & can't walk far sometimes? I have a feeling I don't & just to keep it simple!
I was going to put "As an occupant of the car at that time, I would ask for reasonable adjustment due to the fact I am disabled and own a current Blue Badge" Is that ok?0 -

"As an occupant of the car at that time, I am formally requesting under the Equality Act 2010, a 'reasonable adjustment' of time, due to the fact I am disabled and hold a current Blue Badge which is uploaded here.
As above, and send the same thing to the retail park management and complain about disability discrimination (do not tell them anyone 'went elsewhere...' obviously...!) Instead, talk about planning to make a large purchase and now your family are re-thinking ever bringing your patronage to xxx retail park.
Or is it not a retail park (I realise you didn't use the shops, covered that above...).
BTW don't use car parks like this, it's selfish parking.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hahaha.

It don't get no easier bro! :doh:Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Coupon Mad, thank you. I'll stick that on the bottom about the BB.
It's a pub carpark so no shops. All I can do is see what happens. To be honest, in some way I don't mind paying the £60 as technically it was completely our fault & I feel a little guilty doing the BB/disabled thing as my other half had dropped me off already to where we were going, so I didn't have to walk anywhere. Its just the principles of these people that make want to contest it!
However, yesterday I got another ticket from a local place that has changed the parking to double yellows & put signs up a week or so ago. People always parked there to either go into the petrol station or to Macdonalds if there were no spaces in MacDs/the petrol station. There were no restrictions. We saw the new lines/signs so stopped the car (by the sign regarding parking that's above the double yellows) to read about the new parking so we didn't get another ticket. We were there for about 1 minute, saw that we couldn't park there & drove off.....and a ticket comes through a few days later, different parking company though. I'm happily going to do the same process with this one as I do think they are being out of order. This time I will chase/contest it to the end cos a ticket for reading a sign for a minute really isn't on!! Do I say anything about being parked there to read the sign (& to see if we could use the Blue Badge) & send photos to show where we parked was right next to the sign etc.....or do I just send the basic template & mention why we parked there/being disabled at a later date/bit of the appeal?0 -
