PCN help!Someone parked my private residential bay

Hi all,

I moved in to my new flat three weeks ago, and had bought with a parking bay (no. 6)and permit need to be shown on the windscreen. Last week, I came back from shopping and found that someone parked in my own bay but I need to go to work and cannot wait for that so I decided to park next to it on no.5. And when I came back from work, I found that there is a parking ticket issued saying I parked without presenting the correct permit,( of course my permit is no. 6 not no. 5),but if not someone used my private bay, I would not and do not have to park in no.5.
I complianted to the property management and they seems not very helpful. Just ask us to contact the parking charge management Ltd ourself.

And so we appealed to the PCN and I had photo evidence showing very clear number plate whose car is parked in my bay but they rejected our appeal.

But we think it is very unfair to us, as we paid £25k for a private parking bay and can not park our car and end up having a ticket which is not our problem.

Should I do another appeal to IAS? Or what should I do?

Please if someone have the same experience or know how to fight this unfair system give me some advise.

    Maybe somebody parked in their bay.

    I agree 100% with your annoyance but I can't see how parking in someone else's bay is defensible. Was the other car ticketed? If not, then you can countersue the PPC for not protecting your bay.

    You also need to see the contract that the PPC has with the landowner to see what they are supposed to do for their concession.

    I am not sure if they are having ticket too the car is gone when I back. But I do know it is not my neighbour's car.

    just to be clear, the 2 incidents are separate, one happened because of the other, but that choice was not yours to make, you should have left the site and possibly reported it to the M.A. and/or the PPC

    2 wrongs dont make a right

    if you get home and your house is locked and your key fails, you cannot just come into my house and make yourself at home just because my front door wasnt locked

    so 2 tickets should have been issued that day, due to 2 transgressions

    This is a KNOWN scam permit scheme that you DO NOT NEED, as you say you own your space:

    No it doesn't!

    Stop walking into a scam that will see you penalised at least once a year, e.g. if it's icy and they can't see the permit thru the windscreen at night (not joking), or if they ''update'' the permits and catch you out, or if they shake the car and knock it down...ahem, ''can't see the permit sir, that's £100...''

    You want nothing of this con. Scrape it off your shoe right now.

    Opt out of the scheme immediately, tell the MA that the parking firm are trespassing if they park a vehicle or set foot in your privately owned bay and you accept no contract with them at all. You will not regret it.

    Tell the MA you will be putting in a locking parking post (Google them they are cheap!) instead to protect your land and absolutely never agreed to this scam. A parking post uses a key that you only give to people you want to park there works very well and stops all chancers including the parking firm.

    Re the PCN, if it's from an IPC firm, ignore it unless they try a small claim then we will help you defend it. No risk, no CCJ as long as you do not ignore court papers and do tell the scammer if you move house within 6 years.

    You could knock on the door of number 5 with a bottle of wine for them and apologise for what happened and ask if they own their own space too and what do they think of the parking firm...both of you could end up opting out and telling the scammers to do one. I bet there is bad feeling about the regime.

    You never know, you could make friends with those at no 5 and (if you do end up being sued for this con) maybe they could sign a WS saying they don't have a problem with the parking event that day and there was no loss and they own the space and never authorised scammersRus...

    Who are these Parking schemes intended to protect ?
    Surely Residents?

    Like a supermarket waiving PCNs for genuine customers, the Management Assoc. should tell the Parking company when not to pursue a charge.

    While each parking space may have a legal owner, many (if not most) places would tolerate swaps between legitimate residents.

    The inference is that No.5 did not complain - so no harm done.
    If No.5 had been inconvenienced - but recognised the car - then a note under the wipers should have sufficed.

    I'm aware of a private road where a resident's guest was charged. Plenty of space, so no one inconvenienced
    The resident seemed unable to get the charge cancelled.
    The message seemed "it's out of our control"

    Residents should "take back control" .......

    Sadly, no, they are not intended (by those operating them) to do that at all.

    It's the last thing any scammer PPC wants, and they positively target residents.

    Agreed - but no chance. Stupid Managing Agents like this walk into completely unsuitable contracts with thugs and usually have no such option in the contract to cancel PCNs left right & centre. They are either clueless or they don't care.

    The PPCs know EXACTLY what they are doing and who their targets are, at residential sites.

    Thank you for the reply and as I know no. 5 owner they have no car in their family so make no harm.
    It is just very unfair for paying for someone's selfishness and very frustrated as well.

    And the company that operates the car park is called parking control management (pcm).
    So should I appeal to IAS?
    Or pay that £60 within 14days?

    Yes, imagine when you need to park your car and go to work on time. Some really selfish person used your private bay and you cannot put your car in nowhere. Just very angry situation.

    Further appeals are futile. They will tell you to pay.

    If you don't want to pay sit back and see if they take you to court. Here are the odds

    That is an extension of the scam... the rogue PPC will park their car in your bay forcing you to park somewhere else.

    If you use another bay, as you did, they instantly have another victim.
