  • But that was to be expected, I have almost never seen that as an issue. So what?
    Someone advised me to check the individual requests so I mentioned it again here
    She did WHAAAAT??? She didn't have to do that ''to avoid a CCJ'' OMG. Mugged.
    It was the same company and a CCJ was actually on the credit file, but we had it removed since.

    So in terms of next steps, should I be taking this up in the courts or should I be liaising with the debt company direct?

    It would be a pity if the judge was unaware of this

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

    Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by in the not too distant future.

    Never contact the debt collectors... but you are past that stage.

    Later on a SAR should throw up a copy of BW requesting "further instructions" and if there is no such letter, the issue of "unreasonableness" will come into play.

  • Yes they came back and said they would delay until I heard back from the council. The council came back and said we didn't have any ability to park in the spaces.

    Does that mean it's defunct now what IamEmanresu said?

    I'm expecting that in three weeks SCS Law are going to write and unless I can prove I had a right to park then they will initiate court proceedings like they did with my wife. I'm unsure what to do from here?

    Wait and see, then defend any claim and win in 2019, as 99% of people have reported doing here, in 2017 and 2018.

    I'll not get in touch and then when they respond I'll upload it to here for more advice. Are you thinking I'm likely to go to court?

    I've had the below response back from the solicitors and am wondering what the best response would be:

    I write further to my email below and your previous email dated 7 November 2018, in which you requested 6 weeks to obtain proof from your local council as to your permission to park at the site. 6 weeks have now passed since your email.

    As no agreement has been reached between the parties, our client, UK Parking Control Ltd, has instructed us to issue county court proceedings to recover the unpaid parking charge notices after 14 days from the date of service of this email.

    Please treat this email as the required notice pursuant to paragraph 8.2 of the Pre-Action Protocol for Debt Claims.


    Are they able to issue court proceedings?

    How shall I respond?

    Don't posts #26 and #28 go some way towards answering your questions?

    Yes of course they can issue court proceedings and they have given you fourteen days notice of their intention to do so.

    Wait patiently for your Claim Form to drop through your letter-box.

    Hi all - quick update but UKPC have decided to drop the fines for both my wife and I.

    I think it was a mixture of escalating to our local MP and then acting on the advice in the forum here.

    So a big thank you to those who have helped.
