Hi,
This is a funny one,
i claimed my charges from halifax and after a long process i won my charges.
i took them to small claims court via the website and they didnt respond in the time so i entered judgement by default, i waited a couple of weeks and didnt recieve any money so i phoned them a couple of times, they were saying they didnt recive my papers and they didnt know about default, eventually i phone again and they said the money had been paid in my account a few days earlier (this was back in sept) and i check my account and as they said all the money they owed plus court charges were in my back paid in two parts on the same day. i notified the court by post that they had paid etc.the other day i go a letter from b'ham court saying my case was transfered to them and halifax were applying for judgement to be set aside ? but the've already paid me although i had nothing written from them saying they had just the phone call and the money in the bank.
its as though they dont know they settled,i phoned the court today to ask what was happening and they said they had no notification of them settleing although i did post off to northampton court, they said because its an active case the hearing will go on in a week.
what does this mean, will halifax be able to ask for the money back ?,do i need to attend, can anyone tell me whats going on please.
