What course of action would you recommend then, if anything? It's more likely to be stupidity rather than fraud; whoever filed the claim with MCOL, (*), has probably just assumed that "Britannia Parking" meant "Britannia Parking Ltd" instead of "Britannia Parking Group Ltd" which is probably the correct Claimant.
(*) I did notice in your post no 3 ,that they are claiming £50.00 legal representative's costs.0 -
No they can't because it's not their "debt" and the "debt" hasn't been sold to them.IloveBritannia wrote: »Thank you Castle, but I'm still none the wiser if a dormant company can sue people or not...:(0 -
wrong company making the claim perhaps ?
dunno , judges often overlook stupid (but supposedly skilled) people0 -
I have just dug out a letter from Britannia Parking (of 300 Pool Road, Poole) informing me that my account has been passed to their legal team, BW Legal.IloveBritannia wrote: »What course of action would you recommend then, if anything?
The letter was dated 15th August 2018.

No that only meant that BW Legal were going to act as debt collectors/Solicitors. (Basically debts can't be sold because it would be a breach of the KADOE agreement Britannia have with the DVLA.)IloveBritannia wrote: »I have just dug out a letter from Britannia Parking (of 300 Pool Road, Poole) informing me that my account has been passed to their legal team, BW Legal.

but do the company we are referring to have access to DVLA data , or have they asked AN OTHER to get info ?0 -
No... you need to defend the claim, because a Judge is unlikely to read your defence. Furthermore, Britannia could apply to change the name of the claimant at some later date.IloveBritannia wrote: »Should I then skip all the other arguments and just put to the court that the claim should be dismissed as the claimant is a dormant company?0
