OP have a read of your paperwork. I couldn't find anything on the website but these plans are usually classed as insurance, a financial product.

Meaning you can complain to the financial ombudsman which won't cost you anything or come with any risk to you, unlike court.

  • That's a brilliant idea unholyangel. Thanks!

Moneyinepti - yes, I do, but it's pretty bad that I've had to take five days off work in the last two and a half years to wait in for the repairer and I'm pretty sure it's going to go wrong again. It's the heating element in the oven every time, which suggests an overall fault. I paid good money for the plan and it entitles me to a replacement after four mechanical faults. I've had five. I asked for a new cooker and I was told I'd get one. Do you think I should accept being misinformed by them and take more time off when it goes wrong again?

But for how long? They said it was working 5 times before.

Going by their website, the plans are provided by DSG retail LTD, trading as knowhow. DSG retail LTD are authorised (and regulated) by the FCA (and by proxy, the financial ombudsman).

    But for how long?
My point is that it's current working status would severely weaken any court case.
  • I take your point Moneyinepti, but I'm only stuck with an old cooker that is working right now but keeps going wrong because two staff members didn't do what they should have. Two. The guy on the phone - why did he order the part, knowing that I wanted a replacement cooker? The engineer - why did she do the repair literally just after I told her I was wanting a replacement cooker? I'm guessing it's because a repair is much cheaper for the company so that's what staff should go for if at all possible. Fine, but not to the point where the customer is saying I want a new cooker and they're saying fine but doing the very thing that will stop the customer getting what they're asking for and are legally entitled to.

I think it's worth a punt in small claims.

I would normally agree but I believe the OP only got it repaired because she was promised a new cooker as well as a repair

her plan entitles her to a new cooker that is what she should have.

where the customer is saying I want a new cooker and they're saying fine but doing the very thing that will stop the customer getting what they're asking for and are legally entitled to.

Do the terms and conditions say you are entitled to a new cooker or can request one. If the latter there is no legal entitlement
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales
