Water issue

We have recently sold our barn conversion
when the 4 barns were built in 2001 the area of land was purchased off the farmer who lives adjacent to the 4 barns
however now we have come to sell the buyers solicitor has an issue with the supply of water
this is because the water is supplied to the farmer and then transferred to the 4 properties, there is no water meter on any of the 4 properties and the farmer pays all the water bills
our buyers solicitor is unhappy with this as he feels that the farmer can stop the water supply when he wants, which he has never done in 7 years and there is no reason for him to do this as he runs his farm from the same area
our buyers are desperate to exchange contracts but this needs to be sorted out, any ideas how we get around this? is an insurance idemnity an option?
unfortunately my solicitor is unavailable today hence me asking for help here!!

What if the farmer dies, his son takes over, and decides he doesn't want to pay the water bill for 4 barns so stops the water supply?
Can you contact the water company and get them to fit meters to all properties? (you might have to pay for this, or at least have a quote ready and agree to split cost with buyer)Should've = Should HAVE (not 'of')

I would not like the sound of that either! If I was the buyer I would want my own water suply from the mains. Can you not contact the water board?
On the same note but totally diffrent - I wold not consider a shared drive - in case of trouble :eek:

The fact that the water is not metered should not be a deal breaker.
There needs to be something in the deeds (easements??) to state that the farmer can't interrupt the supply of water to the properties. This should have been done when the barns were converted. I'm surprised one of the purchasers solicitors didn't point this out at the time. Provided the farmer agrees it should be easy to get a clause added to the deeds now.
