Can they take action?

If a debt is over 6 years old, and there has been no contact, technically statute barred, but I have NOT sent the statute barred letter can a DCA take any form of legal action.

What Im trying to find out is can they go to the courts with the old debt if they have no evidence of contact?

Is there any point sending the letter, will the courts see that its over 6 years and not issue a CCJ for example or can they just turn up and get one?

Personally i wouldn't take the risk. If you have received a letter that you believe is statute barred, send the appropriate reply with £1 cheque or postal order.

This thread may provide some sources to follow it up with though.
