recently pulled into a restaurant car park which was operated by a BPA member to use the restuarant. However, when the arrived at the restaurant door it was closed. There was no signage to say what time it opened so the driver returned to the vehicle to find out what it opened. After eventually finding out that it didn't open for hours the driver left the car park without paying. The total time in there was 13 mins from start to finish. the keeper was then sent a £100 fine for this a few weeks later
I've read the newbies section and in a particular the article that told me the driver has a minimum grace period of 10 minutes. Is this is just for parking the car and without taking into account time spent looking for car parking space or time to read signage etc? Basically, the driver entered, found out the restaurant was closed and wasn't openin then left within 13 mins without paying...is the grace period absolutely rigid at 10 mins?can i successfully appeal this ticket? Or is the driver stuck as they didn't pay?
Please advise, any help greatly appreciated

yes
grace periods are not rigid , the phrase is 'minimum grace period'
do a search for BPA re grace periods
this will before the POPLA stage ...
have you complained to the restaurant ?

Hi,
yes i complained tot he restaurant but they say as i wasn't a paying customer they cant do anything. Its especially annoying as they're the only business on the land and still try to charge you for parking even when they're closed

Yes, just send the blue text appeal you have found in post #1 of the NEWBIES FAQ sticky thread.
Send it without change - no alterations or additions necessary.
Send it as the keeper.
Also you need to edit both your posts to avoid giving away the driver's identity.
For example, it was the driver that pulled into a restaurant car park.
Review and adjust the rest of your posts similarly.
There is no place for the word 'I' when describing events on the day.
The parking companies trawl forums like this just waiting for people to trip themselves up and can use your posts against you.0 -

leave lots of 'nice' feedback on the restaurants facebook / trip advisors pages ...
tell them you would have been customers .... but now you will advise family, friends and colleagues to avoid people who do not care about customers
and ...
start reading up on POPLA appeals ... search and find one or more to crib from ... then post up here for people to comment on ...

If it was a camera that got you and if the NtK arrived after 15 days (no windscreen ticket) You have a 100% golden get out based on out of time.
