Hi I'll keep this short. 4th august ssp stopped for hubby. Applied 6th august for esa. 5 weeks later got told it's uc we need to apply for so we did that had the interview they said no it's new esa you need. Applied for that. Got a letter on Sat we aren't entitled and the job centre on money said reapply for uc. Would uc get back dated to the 6th august or from today when we make the claim again. Thanks x

Seems like you're going round in circles here. If you could give us more information about your circumstances then we could advise further. Do you work, if so how many hours per week? Do you have any dependent children? if so how many? Have you checked if your area is a full Universal credit area? http://ucpostcode.entitledto.co.uk/ucdatevictoriaolivia wrote: »Hi I'll keep this short. 4th august ssp stopped for hubby. Hi yes in uc area. Basically hubby was knocked off his bike in January. Shattered his foot. He's a chef cannot walk without crutches yet. As I work full time we can't get income esa and hubby did 2 years stop at home dad when our daughter was younger so can't get contributory at the moment.0

Universal Credit can be backdated for one month if you have 'good reasons'.
https://www.citizensadvice.org.uk/benefits/universal-credit/before-you-apply/how-universal-credit-is-paid/
I suggest you start making some contingency plans regarding your debts as it is possible that your income is going to reduce considerably.
Speak to your mortgage lender and explain the situation. They may allow you a mortgage 'holiday'/to go interest only/to extend your mortgage term whilst your OH is recovering.
Also contact all of your creditors and explain the situation. They may give you a 'break'/stop interest and charges/reduce the payments.
Once you know where you are you can budget accordingly.
Most creditors should be helpful. If any are not, then go to CAB for some advice who will help you with an income and expenditure statement and guide you as to the letters you can write to your creditors, if necessary.
Useful website is the National Debtline.

Hi our income has already taken a massive hit we have 4,000 on interest free credit cards just to pay the bills. We were relying on the back dated esa which would have been 800 ish up to now but after we got the letter we asked my parents to help. Entitled to only came up with £134 a month help with isn't gonna help much at all realistically but if we can get it We will. Hubby has his interview on Wednesday0

As you can see from the link posted above, your reason is not covered by the backdating regulations. Requesting backdating due to ignorance or bad advice will most likely be unsuccessful.
You could submit a complaint as suggested and you also have one other potential option.
You stated you claimed Universal Credit previously and they then advised you to claim new style ESA. Presumably a member of staff closed this universal credit claim. You can submit a mandatory reconsideration about this claim closure as it was closed incorrectly. Hopefully they will then reopen the original claim.
You should do this quickly, if it's been more than a month since the claim was closed you will also need to explain why the appeal is out of date (all the same reason really, but still).0 -
We don't have any debt as such other than the credit cards we have taken out since the accident. We are 1200 a month now income wise so as you can imagine getting quite stressed x0
