Over paid by work

Hi all,

I'm looking for some advice, I have recently finished work, the other week I was paid my final wage with my holiday pay, the following week the company made a mistake and paid me my holiday pay again, this wouldn't be a problem if i still worked for the company as they would take the money from future wages to cover the monies owed but I no longer work there, now your all probably saying just give the money back and all will be fine, the problem I have is that when universal credit do my calculation at the end of my period it will look like I have earned an extra x amount of money, meaning that they pay me less UC, so I'll be missing out out and the amount of money would cover my rent for the month, so if i give my my old employer the money back I lose that money and o also won't receive the correct amount of UC AS they think that I already have had the money, I have been looking at various websites saying that I should look at my works contract to see how they could take the money from me, but I never signed a works contract, I have not spent the overpayment and one will i unless the uc don't pay my rent like they would had they not overpaid me, I know the money doesn't belong to me, but if I pay it back in going to lose out on my UC payment,

Advice would be helpful

    Contact the employer and ask them to put in writing what they have done, so you can show UC?
    Life is about give and take, if you can't give why should you take?
  • I'm assuming here there's a good reason for the job ending or you've got a whole other potential problem on your hands.

    UC will pick the earnings up if they were reported to HMRC. Did you receive a proper pay slip etc with deductions for both of the payments?

    The concern here is that challenging earnings reports can take a long time. I'd imaging in this situation you are going to need a letter explaining what has happened from the employer as well as evidence you have repaid the full amount before UC could correct your payment.

    I think you need try to speak to your case manager directly to see what they advise. I think paying it back could well leave you short the month. If you do pay it back you need to make sure the whole situation is fully evidenced by your employer.

    Maybe they can correct the earnings report with HMRC prior to your payment being calculated but I've no idea really. Have they actually requested you repay the money? They've left you in a right mess to be honest.
  • Hmm apologies for the double post but, thinking about it I believe challenging earnings normally takes a long time because UC go back to HMRC who then go back to the employer. If you can actually provide all evidence from the employer directly maybe it can actually be corrected quickly.

    You need to speak to your universal credit case manager directly and run the whole situation by them
