Landlord Woes - Moving Out, Damage To Carpet, Weeds On Lawn.

Im moving out my rented house in a few weeks time, my landlord has had a walk round to give me an idea of what needs attention before i leave.

He noticed wear on the carpet on the top vertical areas of the staircase. He is suggesting this needs to be replaced from the top stair down. I told him it was caused by one of the tradesmen he sent round a while ago but he did not buy that excuse. So he is saying i need to replace the carpet from the top stair and down to the bottom, my insurance should cover this. Do you guys think i should get it replaced or would the deposit holding place see this as wear and tear?

The back grass is in poor condition as it got burned brown with all the dry hot weather we had, when it started growing again there was weeds growing on the grass like never before. Originally the grass was really bad with moss and some weeds. I have done my best with the lawn, put down patches of turf in the bare areas and cut it at the longest setting. I sent him the pics after i done this and he is still saying the grass needs to be treated for weeds? Will the place holding my deposit agree with him and deduct the work to the rear grass from my deposit?

Its a joke as he has been looking after the front grass for 2 years with his ride on mower, it is in better condition but it still has plenty of weeds, plenty of moss and plenty of bare patches. I asked him why this is ok but not ok for the rear grass and he refuses to answer in my emails.

    No, it's fine. Take it to dispute.


    Cheap carpets easily wear out on those parts
  • Do you have photos of the same areas from when you moved in?
    Is there a check in inventory?
    What does it say about the stair carpets and the back lawn?
    What does your agreement say about gardening, who does it and to what standard?

    If you take it to dispute, then you will need some evidence to back up your claim.
    The landlord will also need to provide evidence to support his claim.
    The adjudicator will then decide.
    Possibly best not to get into an argument with the landlord over the respective amounts of weeds in the front and back lawns.
  • I'd take it to the deposit protection scheme, unless the landlord has photos of the property / carpet before you moved in he's unlikely to win.

    i'd also be amazed if they awarded in his favour based on those photos. the carpet and garden both look in good condition to me!

    I have a copy of the itinerary and its printed on plain paper so the pictures are poor quality. There is no picture of that particular part of the stairs. There is no mention of wear or damage to the carpet. I dont have pictures im afraid.

    Regarding the lawn, there is a picture of the lawn and back garden but again its a poor quality picture and you cant see the lawns condition from this picture. You cant really see what weeds are there or not.

    Im responsible for the garden but my landlord told me from the start he will always cut the front lawn with his big mower.

    The tenancy agreement says to keep the gardens, pathways, lawns, hedges, rockeries and ponds (if any) regularly maintained and in good and safe condition and as neat tidy and properly tendered as they were at the start of the tenancy and not to remove any trees or plants.

    There is a pic on the itinerary but it is of the stairs however its poor quality as its printed on plain paper. Many thanks for your help and feedback. ;)

    The carpet is damaged. TBH it's not important due to location.

    What is important is how old is the carpet? If it's only got 50% life left then you only pay 50%.

    Weeds? Weeds? Is the LL for real? I'd be happy you cut the grass!!

    Ignore and let him take to dispute.

    Many thanks for your reply. Sounds like i should just leave the carpet and the grass for the adjudicator to decide. I can wait for my deposit anyway.

    He is just being a complete a$$ because he can. He was so casual about everything when i moved in and now he is nit picking everything.

    Just keep leaving it to the adjudicator - I had much the same problem 6 months ago and got all my deposit back eventually.
