To be honest I couldn’t believe how unprepared he was, clearly hadn’t read my documents or even their own witness statement. If he had done he would know about them chasing me under law of agency and not the POFA 2012, not sure if that would have helped them or not, but clearly proved he hadn’t prepared!!
I was happy to have the case thrown out so to get costs as well I was really happy!!

Well if your case law included Excel v Smith and VCS v Quayle then you could have exposed them as even bigger BS merchants and even more unreasonable!

Shocking that we still see VCS trying to beat consumers with an argument that the owner of Excel and VCS knows has already trashed at appeal (Excel v Smith) where they were told by a Senior Circuit Judge that their argument about agency was 'improper' and without merit.
