Hi, recently was sold advertising by Yell.com, they made extravagant promises that I would be inundated with business ,I have paid £1,100 for a website and listing.
I was signed up for a 12 month contract ,however 3 months in I have not received a single phone call, I have asked Yell to refund my money but they said I signed a 12 month contract.
The only thing they suggest is that I upgrade my website at further cost. I am not happy with that and told them that they have sold me a defective product.
I am going to the small claims court to recover my money, but I don't know which department of Yell deals with claims against them.
Can anyone help.

  • Use their registered office.

3 Forbury Place, Forbury Road, Reading, Berkshire, England, RG1 3YL,

Did your contract say they would guarantee you would get calls?
  • They lead to me to believe that there was a reasonable expectation that I would get enough business to cover my investment, that is why I gave them £1,100.
The only calls I have received are salespeople trying to sell me more advertising, despite changing the content of
    the website nothing has worked.
They bombarded me with statistics and success stories of others, I pointed out to them that if their advertising model had worked for others then the one they sold me was obviously defective .
I understand that nothing is guaranteed but they should recognise that if something isn't working they should allow me to go elsewhere , I don't mind if they keep part of my money for the time the website has been live.
  • What I meant was do you have any form of 'guarantee' I writing. What does your contract say?

What does the contract say they will do for you?

Unless it specifies any guarantees regards extra business then you are wasting your time.

You paid for a website and listing.....that is what you got and as a B2B contract you are bound to the 12 months agreed.
  • The contract was an E contract ,there is no paperwork or signatures ,it was completed over the phone.
They didn't specify at the time that there was no cooling off period, I believe I was missold a product which hasn't performed as I was led to believe it would perform.
They said the biggest problem I would have would be dealing with the volume of calls I would receive, LOL.

That's not in any way a guarantee.

Don't waste your time (and money) in court with this..

E-contract or not surely it states what is being provided?

Cooling off period - I don't believe this needs to apply to B2B contracts but could be wrong. As a business the onus is you to carry out due diligence which it seems you failed to do.
