    If you have evidence of the sickness I would suggest seeking a solicitors firm who deal in these sort of claims and see if they will deal in conjunction the issues re the quality of the hotel..

    If no medical evidence no solicitors will take up your claim on a no win no fee basis and no solicitors will deal with the quality of the hotel as this will end up in a small claims court so unless you are prepared to pay you will have to do this yourself.

    Speaking from experience of taking TC to court and winning they will try every trick in the book.

    Hopefully your friend filed an in resort complaint form and kept a copy then followed this up with a written complaint on return to the uk.

    Though not fatal it would raise questions.

    Be prepared then for a number letters to pass back and forward and small increments of offers in vouchers.

    If this is not acceptable then you are left with option of staring a small claims through the county court via MCOL but first a LBC has to be served on TC.

    Though can be done by a fairly competent lay person it does involve some researching ,form completing and submitting to time restraints.

    In any case it seems like you posted after the whole matter was finished - if they accepted a voucher that may well have been in final settlement of this issue therefore moot whether it's "legal".

    Would be nice if you came back and updated though as your post was very light on actual facts.
