BW Legal and airport bylaws.

Evening all.

In May 2017 i received a pcn from UK PPO
It was in an airport for parking....but firstly i wasnt parked, im a taxi driver and was dropping off, secondly the double red lines end at the entrance to the hotel, so i wasnt on red lines.

All contact stopped and now i have a letter from Bw legal.

Ive not got any correspondence any more as it wss 17 months ago. I remember reading back then about some bylaws on airport land which meant that after 6 months they couldn't claim. Not sure if this is correct though.

What i would likw to know is can i have a day in court or do they just apply for a ccj without me being able to defend myself

Any advice would be greatly appreciated

    airport land is covered by byl;aws so if they make a court claim you would dispute it on jurisdiction grounds as penalty notices are dealt with by ther MAGS COURT under bylaws, which indeed times out after 6 months

    if they issue an MCOL, the CCBC in Northampton usually send it and you get the chance to defend yourself

    you have to lose in court to get a CCJ
  • 6 mth law does not apply in this case , b+w are trying a few of those cases , dont think any have COMPLETED in court yet , on pepipoo one person paid up before court , another case is on hold , however VCS (who hired BW) have has to pay defendant £95 coz they cocked up with paperwork on the day

    as you are a fully registered taxi driver , maybe you are licenced by liverpool council? (who basically half own the airport ) I would have my day in court

  • in which case OP are you licenced by newcastle counsil? , I would be asking questions of them regarding rulings on drop off and also talking to your colleagues and basically boycotting there site , exactly what many taxis do in my local town at one parking eye site , parking eye were replaced shortly afterwards , new parking co have a whitelist

    Newcastle airport, im licenced by Gateshead council (neighbouring town)
    .my biggest issue here is that i was not on any red lines. They are capped like double yellows are, just at entrance to hotel. I was in a t junction after red lines terminate. Also the fine was for 'parking' and not 'stopping'.

    Basically if i have to i will go to court.
    More interested in the process to get there. Do i contact bw legal by phone, letter or just ignore until i get court papers

    Ignore until you get a Letter of Claim or official court correspondence.

    Ignore does not mean throw away everything.
    Keep all paperwork for up to six years from the incident date.
