He may be, but I do agree that the blanket advice that you can ALWAYS ignore PPC tickets in Scotland as they NEVER do court is over simplification.
Yes, you have an excellent chance in the PPC giving up in Scotland, but each OP should be advised that their chances are not 100%.
Remember that it is THEIR money at risk, not yours and they should be given full advice and not oversold on their comlete immunity.0 -
No-one here ever says PPCs ''never'' do court in Scotland. Some do, a bit, dipping toes in the water.
However the correct position IS to ignore them unless they try court, and NOT to say who was driving.
And as a first step, always always complain to the landowner/retailer.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just thought I would provide an update on how this was finalised as a few threads up on this but we never find out how any were actually concluded
Case finally went to court. My defence was that I was not the driver and due to timescale couldn’t recall the driver. No other issues were in dispute I.e signage, amount of charged, right to sue etc.
They spent most of time proving adequate signage right to sue etc and brung parking manager all the way from Stockport to tell the court this.
Mentioned Robb v VCS case but judge not aware of this case and as it was unreported it was of no use.
Claimants argued that as i had not responded to 4 letters, one for each parking charge and that I was vague about the actual driver this somehow proved beyond balance of probabilities I was the driver.
I stated I could not recall receiving the letters but if i actually had and ignored them it doesn’t make me any more likely to be the driver. Also the incidents were 4-4 1/2 years ago and it was claimants choice to wait this long to bring to court putting me at a disadvantage on timescale to recall the driver so again this does not make me anymore likely to be the driver.
The judge concluded he felt I had received the letters and I actually knew who the driver was but As i was under no obligation to name the driver and the claimant had done nothing to prove I was the driver then the claim was dismissed.0 -

I suspect that will be the last time Horizon try a claim in Scotland
and a warning to the other scammers.

I think your excellent and very welcome report of the conclusion to your thread vindicates my previous post #13 where I said that PPCs can and might do court. The way to win must at least include your defence of not being driver as well as other points.0
