    Sorry to potentially pee on your chips, but what date have you got on your parking charge notice from them (month and year is sufficient)?

    Many thanks for sharing this and well done! This gives me further confidence to take this as far as it needs to go. I have already drafted a letter of complaint to my local MP, which I’ll be posting shortly, thanks to the advice of members.

    In relation to contacting the landowner, as you say, that would also be pointless as they pass off all responsibility in that they state on their website “The Harbour Authority will not respond to penalty ticket issues”.

    Is anyone aware of any recent cases of Armtrac Security take it as far as court action and what were the outcomes?

    The outcome of any small claim will depend on the strength of the PPC's case, the strength of the defence, the performance in court and ultimately (and all that matters) the decision of the Judge.

    No matter what you do (other than pay) there is virtually nothing you can do to stop them doing whatever it is they want to do.

    The main thing is that you are prepared for it (by advance reading of the NEWBIES FAQ sticky, post #2) and know what potentially might come your way, and know how to deal with it.

    The better prepared, the better you will handle things successfully.

    Whether they respond or not, it is NEVER pointless to add to the complaints! Come on, think about this, the Harbour Authority must be royally fed up with complaints about this regime, if they put that on their website.

    So OBVIOUSLY add one more angry complaint and copy in your MP for good measure.

    Re court outcomes here, we have 99% win rate and no downside (even if you lost). ALWAYS DEFEND!

    I'm so sorry - I'm new to the forum & not familiar with etiquette. I felt I had jumped in with reassurance about armtrac for the OP which wasn't necessarily correct , as more experienced posters pointed out, and so I deleted without thinking. My apologies.
    Not before that ghastly Mick Cooke saw my post however (He is obviously a keen, regular viewer). He promptly sent off, same day, another demand via registered post to shut me up anyway. So it looks like he will move along to stage 4 of the Sennen scam and pass me over to TNC for some gratuitous tedium. I will ignore of course and come back (if I may) to the forum for advice if he finally gets Gladstones to threaten court.

  • There will probably be a year or so of threatening debt collection letters while they decide whether to pursue a claim. I wrote to say that I was disputing the charge and so there was no debt but they kept sending the letters anyway. In case it goes to court, it would be worthwhile doing some groundwork t be prepared. Maybe the Harbour Authority will let you have a copy of the contract with Armtrac, just to see where the different responsibilities lie. If they claim, it will be for breach of contract. Can you decide when the offer and acceptance was made? Check that there are no loopholes. In my case it was unclear, although the Judge was not inclined to look at this in detail. As you paid, then consideration passed, so the main commitment of the contract was fulfilled. The breach of conditions would be "not displaying the ticket correctly". Hardly serious and the damages for this cannot, surely, be high - what did it cost them? Nothing. In any case, you showed the ticket to the inspector, and so they know you had paid, so there was no breach really. And why cannot a PCN be cancelled? It's only a piece of paper.

    Because the scammer firms like to operate in a way that only makes money from penalties. They do not get paid by the landowners, and they do not get the PDT machine income either in most cases (as you found out).

    They offer their scum 'service' for free, like a protection racketeer. And many of them only go through the motions of appeal, then sue. There is no business model with these firms; it's just suing people for fun, pot shots at the public, for no service provided.

    Awww and they can't go cancelling PCNs, can they? How else would the likes of Simon Renshaw-Smith (an ex-clamper, Captain Clampit) afford to mix with royalty on yachts/at horse shows or wherever the rich mingle?
