NIP but I think it was the car undertaking me

So on my drive to work there is a 50mph dual carriage way, this goes up hill to a bridge where sometimes a police van sits with a speed camera. The first time I saw this I may have been going a little over the speed limit but saw it and braked, I got no ticket. I presumed I saw it from a long distance (the furthest you could with it being just after the top of the hill).


The other day I was driving along, overtook some cars in the left lane and there was a Nissan following behind me. I was going a little over the limit but had an eye out where the van would be, as I came up the hill I saw the top of the van, braked slightly to be sure I was under 50. Now I did this when I saw the top of the van, so if I was speeding the camera could not have had line of sight. When I braked I checked my mirror and saw the Nissan change into the left lane and undertake me as I pootled along well below 50mph. He got alongside me, maybe slightly ahead then slammed the brakes on when he saw the van.



I've received a Notice of Intended Prosecution asking if I was driving. The last time I was caught speeding (2009!) I asked for a picture, and sure enough there I was speeding. However the letter says you can't do this, so I get the impression I'd have to take it to court to contest it and face a much bigger fine.


Has anyone had experience of making an informal appeal? I understand you can write to them and they will review it. I'm pretty sure the radar has just clocked the car undertaking me, and it's been processed and applied it to me as I was in the outside lane.

Any advice is much appreciated!
