Ongoing BW Legal nonsense

Evening all
Thanks for an extremely helpful forum
I have a fairly quick question for now
BW Legal have been corresponding with me for a couple of years regarding an unfair PCN from 2015. I've just recieved a Letter of Claim. I've responded to one of these in the past (I think, I've responded to a lot of their nonesense), but having read more about it recently I think I can write a more robust response this time, so would like to put a little bit of time into it.
Problem is I just don't have the time between now and their deadline of 18th November (I'm in final stages of writing a dissertation, plus very busy at work, a couple of big family birthdays - it's just one of those pinch points).
My question: is there anything I can do to put BW Legal off for a couple of weeks, until mid December? Any point in writing to them ackowledging their letter and saying I'll get back to them more fully by 18th December? Any tricks I can pull? Or should I just copy and paste my previous response?
Many thanks in advance for any advice

Hi again
Getting in a muddle here about how much I need to adapt the template LOC response to my case. I might be overthinking it, but I don't want to send a clearly cut-and-paste response that shows I don't understand what I'm talking about (which I don't entirely).
I'm trying to adapt the template LOC reponse from LoadsofChildren, listed in the newbies thread. The thing is BWL have disclosed the evidence/information to me in two previous correspondence (this has been ongoing for 3 years); photographs of the car park, plan of where my car was, where the signage was, details of the claim, explanation of costs - most of the things listed in the template response that are relevant to my case. (I don't know whether the POFA thing or the keeper/driver thing are relevant). TBH I'm pretty clear on what they see as the case and their stance in relation to it, although the evidence isn't included in this particular letter. Should I just ask for all of this information again as part of the 'dance'?
The specifics of my case are that I was parking in a car park that was operated by Excel under normal conditions, but for the duration of when I was parked there was a temporary arrangement in place for people going to particular event. These conditions were explained in a temporary sign at the entrance to the car park that said to pay the attendant a special rate of £1, that parking was free if no attendant was present, and also said nothing about the ticket needing to be displayed.
I had bought a ticket but it blew off my dashboard when I closed the door.
I have photo evidence of all of this, plus a confirmation email from the event organiser, which I have sent more than once.
Excel/BWL have never acknowledged this temporary arrangement, just keep reiterating that the Excel signage was clear.
Is there any more specific evidence that I should ask them to provide at this point? Any suggestions on any case or protocol that I can refer to to make my rebuttal more robust?
Any advice would be greatly appreciated - I have to get a response in the post in the next three days.0 -
you send a LBC rebuttal similar to all the other ones posted recently, to BW LEGAL
you send the PPC an SAR under the GDPR as well, by contacting their DPO and asking for ALL evidence , docs , pics , fuiles, contract , signage etc
this isnt rocket science, most of the work IS copy and paste, with alterations as required
none of this is about what happened0 -
How much are they asking for? If they were to take this to court and win, the maximum a judge would be likely to award is i.r.o £175 - £200, anything more is pie in the sky.
If they want their usual £240 - £260 you might be able to buy a bit of time by asking them to itemise their claim. Are they charging more tham £50 for legal, have they added £60 for debt collection, do they want interest from the getgo? All sums they try to add.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.
Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by in the not too distant future..You never know how far you can go until you go too far.0 -
Thank you both for your replies.
Sounds like I'm overthinking, will get on with a standard LOC response0 -
Is there a work-around for the no copy and paste thing on here? I have tried pasting out of notepad but it was unable to post, not sure how to share my LOC response, other than retyping it in this box - thanks in advance0

I say don't adapt any template, it is too old now, it's long and lists things you have no interest in.
Just say what you want and why you are not liable, and send a SAR to the parking firm's Data Protection Officer online, as stated on all the other LBC threads in recent weeks.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks Coupon, yes this is what I have done having seen your recent posts. Will send and be back on here when the inevitable court papers arrive.
