APCOA - Luton Airport - WON

Luton Airport dropping off...

PCN issued: 21-Aug-18
Contravention: 30-Jul-18
Contravention: "Dropping off or picking up outside designated areas at London Luton Airport Central terminal Area"

Vehicle driver turned off the airport approach road into mid term car park and picked up their passenger before the car park entry barriers... so was ticketed by the ANPR (for effectively stopping on the road)

The usual garbage was received from APCOA demanding money with menace. An appeal to APCOA citing the usual issues folk have relied on previously (byelaws not applicable, Airport Act 1986, amount demanded is penalty, no keeper liability, not relevant land, misleading and unclear signage, no landowner contract, no grace period etc etc) was as expected ignored.

An appeal was made to POPLA on the same grounds that APCOA had ignored. A few days before APCOA's evidence submission period was due to expire POPLA email to say

"APCOA Parking have told us they do not wish to contest the Appeal. This means your appeal is successful and you do not need to pay the parking charge."

NEVER NEVER NEVER pay these tickets - they have no legal basis upon which to issue them and they know this.

    typical of APCOA to throw the towel in when a proper popla appeal is written, they should be penalised for doing it so often

    They didn't respond to my appeal at B'ham Airport.

    Maybe they didn't like the "Wasn't me. I didn't do it" appeal.

    Seems to have covered all the bases as far as I can see. Not
    much else to add to that. :)

    they never do respond to an appeal, because if they had submitted evidence then they would have paid out money when popla ruled against them


    so they always duck out when they see a decent popla appeal, which costs them nothing

    I have just received a charge for the exact same thing at Luton. I appealed to APCOA with the template recommended on the Newbies page for parking tickets. I received a reply with an unsuccessful appeal and POPLA code. Would you be willing to post the appeal letter you sent to POPLA that I can use please to ensure I am using the correct information? Many thanks

    They have waqsted your time, now waste theird, complain to your MP

    It is the will of Parliament that these scammers be put out of business.

    Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    You don't need it. The template is everywhere...

    Just search the forum for APCOA Luton POPLA as keywords!
