Shared ownership - can they be kicked out?

I am moving onto a new build estate (well its not a big estate just a road of new houses), some of the houses here are shared ownership. I have been told by people in the town that someone that is quite unsavory (drugs and violence) is getting one of these shared ownership house.

I have heard that with council owned house these types of people can be moved on - but with shared ownership what would happens?

    It does seem like a very odd position doesnt it? As the council/housing assocition owns at least 51% (controlling interest) in the property on the one hand you'd think they'd have the power to move them on....but on the other they do legally own their share of the property. As an example - if I didnt like my neighbour I dont think I could ask anyone to evict him!!! but he does own his house outright, so to speak.

    Out of interest, if you talk to the housing association and get an answer would you post it here.....I am very curious as to the answer on this one.

    Im sure if enough of the tenants object to the unsavory potential canditate and you can prove your reason for concern ( or direct the HA to such evidence ) you should be able to stop it before the nessesary paperwork is completed, afterwards would be impossible. Your HA should have a social responsability charter... for instance proof in the way of court evidence that the person was convicted of dealing drugs from a former residence or has a history of criminal activity for drugs and violence surely proves he is an anti-social tenant and you all will not accept this could pressure the HA to change thier mind. Setting up a tenant/owner co-operative or neighbourhood watch would be benifical to you all as by law these are sticky situations there is not much the law can do as you own a percentage when you signed on the line, thus meaning you cannot be evicted unless you fall in arrears with your rental percentage with the HA or your mortgage arrears with the lender or both.

    If SOME of the houses are shared ownership the that could follow that some would only be for rent only.If thats the case with this chap and he is RENT ONLY then getting him moved on could be done if he is nuisance to his neighbours.Think ASBO !!

    We're shared ownership and one person in the flat next door (rent only) was a real pain. The association knew the problems and eventually they evicted him. No problems since. Don't know about problem shared ownership neighbours though.
