CCJ, BW legal, no claim pack, set aside?

Dear All, My son received a Judgement for Claimant (in default) from Premier parking solutions/BW legal dated 5/10/18 for £261.64. This claim relates to a parking fine from January 2018. This was the first I knew about it. I contacted Nottingham County Court Business Centre as he had received no previous correspondence from the court, only the usual threatening letters from BW, and certainly no claim pack. They responded that the judgement was entered on 5/10/18 and then set aside on 12/10/18. No action to set aside had been taken by us. What does this mean? How has it been set aside? What shall we do next? I think time is marching on with this, and after many hours searching forums, I can't find the answer-I'd be really grateful for any advice! Thanks

    Well, did you not ask them about the set aside and why it was granted? That would be an obvious step to take, as we dont know either.

    If the judgement was set aside, there is no current claim. The claimant would have to restart the process folowing whatever Order the court gave when it granted the set aside. All of which is information we do not have.
  • The email only came today. Will the court know why the CCJ was set aside or will I need to contact BW? If I now do nothing else, is the matter closed? Sorry if these are stupid questions- I've never been involved in anything like this before!

    The court will know - they were the ones that ordered the setaside.

    I would call them
    Email is unreliable when it comes to the CCBC

    I told you it was the court when I said the JUDGE set aside the judgement...
  • Ok, there was a printing error apparently and no claim pack was sent out. A new one is being generated today, so we will still need to figure out what to do about the CCJ

    The CCJ has been set aside. You do not need to do anything about it.

    You will however, need to defend the claim when it is received.
    How you might do that is fully described in post #2 of the NEWBIES FAQ sticky thread.

    "Set aside" MEANS there is no judgement any longer.
    Hence why there is a new claim pack being sent out

    As above, you MUST read post 2 of the newbies thread, over and over and over, and before you ask ANY questions on procedure, you check there first. Bookmark it. I
